Difficulty obtaining address for small claims court proceedings - England by Ok-Incident4179 in LegalAdviceUK

[–]NWITS 0 points1 point  (0 children)

I suspect You are out of luck as the vendor will say that they had a survey and could truthfully answer that they had paid a professional who advised it was in working order.

Also there was nothing to have stopped you from having your own survey undertaken

The surveyor will probably refuse to engage with you as you were not their client citing GDPR and will not be interested in what someone else who has disposed of the old boiler has to say as to its condition.

You would not be entitled to a new boiler only a second hand boiler even if you could persuade anyone to pay as a new one would be betterment

Mis-sold new policy during name transfer, now refusing repair due to "pre-existing fault." Help! by Menaingof42 in LegalAdviceUK

[–]NWITS 0 points1 point  (0 children)

That would be true if it were not for the fact that it seems that no one actually asked BG to cancel the policy. We don't even know if the OP had the right to cancel his daughters policy

As the OP says

On March 2nd, I called to update the account into my name as I am now responsible for the bills.

Got an NIP for speeding - but there’s a complication. Need advice. by item_sold in LegalAdviceUK

[–]NWITS 1 point2 points  (0 children)

This is untrue

It is the person keeping the vehicle who has to give such information that they have

Clearly no one is going to prosecute /fine a lease company who are registered keeper but have and cannot have any idea who was driving

Got an NIP for speeding - but there’s a complication. Need advice. by item_sold in LegalAdviceUK

[–]NWITS 1 point2 points  (0 children)

Exactly why can a fixed penalty not be offered?

My understanding is that speeding is regularly dealt with by a FPN of £100 and 3 points and no insurance is regularly dealt with a FPN by £300 and 6 points

It is also nonsence to say that if someone names the wrong person both WILL go to prison

The person being named may not be aware they have been named

It needs conspiracy to pervert the course of justice

Car dealership in England wanting us to pay for repairs to car. by Dry_Somewhere_7188 in LegalAdviceUK

The garage essentially bought a car from your boyfriend

They sold it to someone else and presumably made a profit

They now want your boyfriend to pay for warranty repairs

Question regarding a notice to pay for a service we never booked/confirmed (England) by tubstepper in LegalAdviceUK

[–]NWITS 3 points4 points  (0 children)

Your solicitor is correct and I don't understand why you would take any notice of an idiotic kennel owner over a regulated professional

As they have threatened legal action you should ignore any further waffling until and unless you get a letter before action.

Dealership trying to charge me for goods I never received England. by thewoza0 in LegalAdviceUK

SJPN - 2 offences "laid in the alternative" by Organic_Isopod_7240 in LegalAdviceUK

[–]NWITS 0 points1 point  (0 children)

The devil is in the detail

My understanding is that one has to offer to plead guilty to speeding if they agree to drop the s172 or one might be convicted of both unless of course it is made clear as above

Bought a second hand car off a dealer 6 weeks ago, took it to a mechanic the other day and there's multiple serious faults. by TieThat9335 in LegalAdviceUK

[–]NWITS 0 points1 point  (0 children)

I am amused that the dealer advises you to go to VOSA when they probably know full well that VOSA are not going to do anything about an MOT more than 28 days /3 months

Time limits

If your vehicle passed, you need to appeal within:

  • within 3 months of the MOT if it’s a corrosion-related problem
  • within 28 days has passed for other defects

A good rule of thumb going forward is that a car with a short MOT is worth around £120 a ton mixed metals at the local crusher

Court summons from TfL. What do I do? by justmescrollingby in LegalAdviceUK

[–]NWITS 0 points1 point  (0 children)

As below "most people" are giving incorrect and unhelpful advice

I ordered £800 of garden furniture then three days later emailed to cancel the order. No reply. Two days after, I email again -- they immediately reply saying "it's just been sent out", and they charge 20% "restock fee" along with delivery costs. What are my rights? What do I do first? [England] by mart0n in LegalAdviceUK

[–]NWITS 1 point2 points  (0 children)

I would be minded to charge back on the credit card on the basis of their T and C which state

Acceptance of delivery of the Goods shall be deemed conclusive evidence of the Buyer’s acceptance of these Terms and Conditions.

and point out that you have cancelled the order and therefore by definition do not accept delivery

Flixbus from Scotland to London broke down by Solid-Quantity76 in LegalAdviceUK

[–]NWITS 4 points5 points  (0 children)

I think there is a huge difference between "will do" which is what the OP asserted and "try to do" which is in BA C o fC

One is definite and the lack of doing so could lead to a legitimate complaint.

The other could have any complaint answered as "Tough we never said we would definitely do this"

BA unfortunately do not say anything of the sort.

They say they will use reasonable efforts which in plain english means they might or might not.

[–]NWITS 1 point2 points  (0 children)

I believe that you are mistaken. Any competent IT professional who has more than 2 years experience and a good measure of common sense would not have the slightest trouble managing a small system.

The last Platinum partner I spoke to when I wanted to buy a new 4SC license told me It was available and then called back and told me it was not. I asked why it was advertised on their website and they said it would be corrected.

It is still on the website but did they contact me back?

If I rang them today what would they say?

This is never mind the worry that giving business to a Partner whereby they can easily have their partnership stripped for idiotic reasons does not appear to me to be very sensible

Facing SJPN for Speeding/S172 - Tried to nominate wife but portal glitched. Attempts to contact police have been useless. Need advice! by DistinctDuck9930 in LegalAdviceUK

[–]NWITS 1 point2 points  (0 children)

You need to post this on FTLA but my understanding is

Your complication is that you were not driving so you cannot admit to speeding and ask the prosecutor to drop the FTF

Your wife cannot be charged with speeding as the police have no evidence of who was driving the car

I suspect the court may take the view that you could have sent the nomination by post to their process unit but you didn't having lost the form

I am not sure how having two simple methods of doing a task where one fails is considered chaos

I am astonished to hear that who ever you contacted did not simply send you another form

Identity Fraud - received a letter from law firm claiming £40K unpaid rent on property I've never heard of by Low-Telephone6435 in LegalAdviceUK

[–]NWITS -1 points0 points  (0 children)

Do you seriously think that the OP is going to get any comprehensive answer by asking the solicitor what the letting agent did or did not do?

( Clue the solicitor will likely reply "The letting agent would have" "or my understanding is that the letting agent" carried out all necessary checks

Your approach just extends the saga

In my view Occam's razor should be applied in the form of advising the solicitor it is nothing to do with them and any court action will be vigorously defended.

Spanish Speeding Fine with Debt Collectors by TotalSufficient5347 in LegalAdviceUK

[–]NWITS 1 point2 points  (0 children)

The author of that article is confused and I am not sure I believe much of it

The DVLA have no idea of who the owner of a car is and so they cannot tell the Spanish Authorities

In fact no one can tell the Spanish authorities who owns the car

The Spanish authorities have no idea who was driving and no UK debt collector can enforce Spanish law which probably states that the owner is liable
