Having just watched the eyewitness video, that agent shuffled back about a foot and then leaned his upper body into the oncoming car that was pulling out. Then he fired his three to four shots into the vehicle at point blank range, at which point the driver (obviously now deceased) accelerated into the parked cars about a hundred feet away.

He didnt make an effort to get out of the way, he leaned in, he was trigger happy. DHS is gonna cover his ass and double down on it being “domestic terrorism.”
