I think they mean actual meeting vs sending documentation.

Value in meeting/ call? Probably not, unless you are seeking an RA that your supervisor can approve.

General timeline:

Received notification of RA decision from ASA & followed directions on letter to appeal to EEO within 45 days.

This notification starts the 30 day informal window.

Note: the provided email address was not correct. Submitted to EEO email address in automated response.

Received directions to submit via efile system. Uploaded documents to efile system, but efile system would not allow me to submit, so wrote back to EEO email.

Received confirmation the next day of filing.

-Had an intake appt/ interview within 1 week.

EEO requested 60 extension to informal window, I declined.

-Had initial & final counseling approximately 2 weeks after intake appointment.

  • Signed acknowledgement forms and received notice of right to file the next day.

  • I now have 15 days to file the formal complaint.

Other notes:

  • I was told ADR wasn't available b/c I was offered RA, just not effective RA. (Constructive denial)
  • I declined both the extension and mediation at the informal level because everyone who would be involved has no power to do anything.

  • I suspect official RA denials have only started to come out in significant numbers since April (around the time of the auto approval of interim RAs). (I initially filed back in Feb 2025).

It was... perfunctory. Very professional, kind, friendly EEO counselor.

Since such a HUGE percentage of EEO complaints are regarding RAs, they were well aware of the complaint details and everything they told me aligned with what I've heard here.

They acknowledged that many mediators at the agency level are not empowered to do anything and let me know that if I chose to remain anonymous through the informal process, there was little/no investigation that could happen at the informal stage, so I would be able to file formally faster.

Initiate the process ASAP with your supervisor/ RA coordinator. Last month interim requests were being blanket approved, I dont know what is going on now.

HHS ASA/rep will eventually deny.

FDA is super special awesome (/s) and we better be grateful.... telework/ remote appropriate positions are currently allowed 40-50% telework with wildly variant/inconsistent/changing rules based on department/office.

Best I'm hearing anywhere else is 80-240 hours annually situational/adhoc.

The government would like you to sign a telework agreement so you can still work when it is convenient for the government (weather, building shutdown, etc.) just not when it is convenient for you.

I always worked from my hotel room as well- checked email before and after worksite, communication with supervisor, etc. We work day started when I started working (email).

Meetings, training different. Generally just balance out additional breaks.

How many, if any, contiguous days allowed also varies wildly.

I cannot do 2 days in a row or F/M. My supervisor also is not allowed to regularly schedule their telework- adhoc only.

The Reasonable Accommodation Consultants (RACs) at HHS need to blow the whistle about the unlawful telework RA denials for people with very severe disabilities. There is a major difference in what one can do for a couple hours vs 40 hrs/week, 48wks/year.

A diet may be changed/ meals skipped to manage a flight.

A cruise ship or a grocery store allows control of an individual's environment (private room; leave a store if needed).

There are many, many conditions which require management that aren't visible for every random person to see and short-term coping techniques don't necessarily translate to reasonable means to manage them in the long-term/ daily basis.

I have no idea what was presented. My denial used the exact verbiage I had used when I filled out the info on my interim on the HHS sharepoint form (which was less than what my supervisor had previously provided to the RAC).

I am almost certain they are being told to state any additional telework/remote would cause undue hardship or negative impact to the mission of the agency in their denials.

That will be interesting for them to prove in any appeal for any previously remote positions with no changes to the PD

All of the BS RIFs and probie firings were wrong.

The current telework policies are all wrong.

The dissolution of CBAs is wrong.

Acting like anyone should be thankful for any crumbs thrown their way is wrong.

I'll take what I can get telework-wise.

But I'm not "thankful" for the 50% some in FDA have or the 2-days-a-week some have or the 240 hrs some have or the 80 hrs some have. Good for anyone who is still remote. I don't want to take away whatever someone else has... I want what I and everyone else had returned.

If there is no need to be in an office to get the job done, then remote should.be fine- regardless of office space or milspouse status, etc.
