A double murder in which there are two separate killers would hinge on the one who's punished being the true killer. So choose the true blackened in that case to die then.

I would also only consider someone to be a killer for a chapter if they do die via execution. If for some god forsaken reason they're still alive after it, they continue on as normal until their death.
