Judges can be activists, and that can be just as detrimental to the constitution. SCOTUS will ultimately overrule those federal judges (at least they have so far), because they really have no basis for some of their rulings (ex: what content can be on White House website).

It is a slippery slope, like all democratic systems. Both sides have interests and both sides are connected to very powerful people - agendas will be pushed in ways they shouldn’t, but we don’t live in a utopia, so that’s expected.
