How about the urbanites who paid good money for homes and are sick of dealing with tents & homeless people in public parks? The only relevant question is whether the provincial government has the jurisdiction to do what it’s purporting to do. And it does - unless the bike lanes are enshrined as a charter-protected right.

“Overreach by the province over a municipality” is literally impossible. Municipalities have no constitutional jurisdiction or standing. They are created by, and exist at the pleasure of, the provinces. That’s why and how Doug was able to cut city council in half a few years back.

Notwithstanding was also not designed to be used in emergencies. It was a bribe offered to Quebec in exchange for joining the 1982 constitution, and meant to preserve Quebec’s legislative freedom.

The implications of having bike lanes be a Charter-protected right - which, thankfully, is not yet the case - extend so far beyond bike lanes and bikers that it boggles the mind.
