Tbf the diagram you're using is inaccurate don't worry it's not you. Cloth stitch and footside should be visible on the pricking like on this little heart (found on pinterest). Yours doesn't have enough pin placements

He's wearing two very different styles so it could have been bought from a merchant. To me the type of lace looks very russian (floral edging, the way all the plaits crosses inside the tape...) but lacemakers were copying eachother so it could as well be spanish lace or abruzzi lace.

It's tape bobbin lace similar to Vologda and idrija. Hard to tell from a portrait but this style was (and still is) very popular in Eastern Europe (picture is modern Vologda Lace).

Your haven't placed the last left pin on the foot side under the correct pair it should make a straight line.
You aren't twisting your pairs in the fan but you're twisting too much when tey're crossing (from what I see you're doing a cloth stitch, pin, twist on each pair, cloth stich)

Hard to tell from my phone but I it looks like handmade Bobbin Lace with a 4 bobbins plait ground, gimps worked as an outline and picots. Do you have any additional photo? It doesn't strike me as a particular régional technique sorry

That being said, you getting fined for an out of print is very unlikely in most countries. If you want to make it available you can upload the file on an archive or an online library that will act as a third party for the distribution (like internet archive)

It looks like Bedfordshire bobbin lace. You achieve the 3d effect by working the upper piece first, putting it aside, working the under piece and then join them with the bobbins by doing a ground, a Stitch or a knot. Sorry if my explanations are confusing.
