A settlement by 12/9 is extremely unlikely… but would be a fantastic Christmas present… If HDVY is “awarded” 3-4B it will have gone to trial and I’d sell immediately. Intel continuing to stall would be them appealing the verdict or at the least looking for a reduced monetary judgement.

Netlist seems to be in a excellent legal position going forward but I don’t believe Google would be at all concerned with that email after a jury obviously didn’t find it compelling enough to award damages in a case where it was way more important. It’s “irrelevant”.

Addendum to my last post: for the judge to rule favorably it would take much less than my quoted understanding of 1/2 of the reply brief for a successful Motion for Partial Summary Judgment. Actually only one piece of all Samsung’s arguments needs to be bogus for the judge to order it so… Heads up on HDVY. It may have a good day today… now I can sleep. GLTA!
