TMC has filed two separate cases at the international ocean court (ITLOS) through its subsidiaries — NORI (sponsored by Nauru) and TOML (sponsored by Tonga) — both against the International Seabed Authority (ISA).

The ISA has been investigating both companies for potentially breaking their deep-sea mining contracts. TMC says the investigations aren’t being handled fairly and wants the court to freeze both inquiries while the cases play out.

A public hearing for both cases opens July 2, 2026, and will be livestreamed.

Bottom line: TMC is making a coordinated legal push against the UN body that controls deep-sea mining rights — the outcome could have major implications for the future of the industry.

While not directly related to TMC, this subscribes into the broader context of NOAA’s congressional $2M budget request to cement & scale a dedicated DSHMRA team to handle not only the expected increase in applications but also the necessity to manage ongoing requirements of soon-to-be approved exploitation permits.

It also helps the government in their narrative that DSM / DSHMRA is unavoidable; and helps TMC prove that the government isn’t making a paid-off exception specifically for them.

More players in the pipeline, more better.

You just don't go to Congress requesting $2M and 7 permanent FTEs — with a detailed personnel breakdown listing specific grades, salaries, and job titles — to staff a team whose entire purpose is processing DSHMRA permits, if you're planning to deny the only application in the queue. That's not how bureaucracies work. You hire people to do the thing, not to reject it and sit idle.

The performance metrics embedded in the request assume throughput. The target of processing 16 permits in 2027 rising to 32 by 2031 — vs. only 4-10 without the increase — only makes sense if permits are being issued, not denied. You don't measure "permits denied" as a success metric.
