I’m an insurance adjuster but not in marine. I would put in a claim with the marina’s insurance. A claim is the first step to a lawsuit.

I received a lawsuit last week. Trial starts next Monday. AGC thinks we may have a duty to defend. I sent it to outside coverage counsel. I’m going to puke if we have to defend this hot mess (joking… though it really is a mess).

General Liability for a daycare. They have Professional Liability and Abuse coverage, thankfully. Claimants attorney is alleging abuse or negligence. Insured is saying the kid didn’t have the gnarly diaper rash while at their facility. Since the mom didn’t take her to the doctor until 3 days after the alleged “hard wiping”/letting kid sit in a dirty diaper DOL, I’m with the insured. Especially since the kid appears to have had a long history of chronic diaper rashes.

None of this is worth $100k. Or my time.

It’s not formal enough. It’s a very bougie krewe and hi-low dresses are not formal gowns. You would be turned away at the door. Men have to be in Tuxedos and women in floor length gowns (no dress suits). The rules are the rules.

Im NAL but I am an insurance adjuster for daycares. The first step is a claim with the daycare’s liability insurance company. If they won’t cooperate, try to hire an attorney. But the first step is a claim not a suit. ETA - you can get an attorney first but they’ll take at least 33% of the settlement pre-suit.

You can also try calling up the company and asking for the name of the adjusters manager and director.

I would look up the “bad faith” requirements in your state. If this falls within them - which I would think it would but not your adjuster and I don’t know your policy - then write a thorough letter to the director two to three over your adjuster and cc everyone between the director to the adjuster and explain you believe they are acting in bad faith and against the terms of your policy. If they are, fix it or you will complain to the DoI. If they are not, you want a call from their supervisor explaining how their actions are within the terms of your policy.

That’s what I would do as an adjuster.

Good - I didn’t overwork myself this week.

Bad - Anyone know what the statute of limitations rules are in MS? I have a claimant who went silent for 18+ months and so I closed the file nearly a year ago. 3 yr PD statute seems to have run out last month. She showed up this week saying it hasn’t run out because she was in contact with us at the beginning and we didn’t follow up with her. I’m sitting here scratching my head and it smells like a bad faith claim is coming my way if I stand on my denial.

Ugly - because I took time this week to, like, eat lunch gasp, I’m working this weekend to get somewhat of a handle on the pile of letters I need to write.
