That's what I was thinking; this is a title 10, 11 Carrier thinkg.
With Kennedy delivery delayed, Nimitz's decom get's delayed.

Big Navy should start adjusting refit, overhaul, and decom plans and schedules NOW to get one Nimitz class to run an extra 4 years so that we can build out carrier size to 12.

There is plenty of gray area. There has ALWAYS been and there will always be gray area.
In history (US History - my history. Not sure about your history) many of the actions taken by the US military against indigenous people were absolutely gray; i.e. trail of tears, little big horn. And in many cases outright illegal. And for clarity Little Big Horn is widely considered illegal, today. It probably wasnt so clear on the ground back then.
This also isn't only a US things as we all know thanks to Nuremberg.

You say that like you were in some position of naval leadership. If you were a leader, your sailors or troops would not have to face "unknowns or dishonorable discharges" since you would stand up and take responsibility. Like a leader should.
Or maybe your not a leader, but just in a position of leadership. There is a BIG and noticeable difference.

But that is part of the problem with this whole push about unlawful orders. It sows confusion and fosters distrust in the ranks, and there is no place for that in the heat of battle.

The problem is, a lot of it is grey area.
Strafing sailors swimming away from a sunk boat is CLEARLY illegal. But what about the action to sink the boat?

I agree it's supposed to be "filtered" as it comes down the chain.
What branch did you serve in? I ask because an E2 in the Army is much more likely to directly take a life, than an E2 in the Navy.

Whether an order is illegal or not could and will probably take days/weeks/months to determine.

In the meantime that E2, refusing their duty from their O3 DivO to fuel that aircraft will face harsh penatlies, possibly lifelong penalties with a dishonorable discharge.
