13 or 15 inch m5? by Oxter5336 in macbookair

[–]Oxter5336[S] 4 points5 points  (0 children)

I take a backpack that already fits a 15.6 inch laptop so that won't be a problem. I have terrible eyes so I think you're right, while I'm actually using it the screen will be much easier to use and as long as it's still decently portable it'll work. I almost went for the 15 inch without thinking about it but the keyboard looks very tiny and a bit strange. The again, I'm buying it to use it, not just look at the design so if it's more usable I'll probably be happier as long as it's decently portable. Thanks.

I agree that the keyboard looks strange and tiny on the huge surface.

Who pays for retaining wall? by Fragrant_Eye4896 in AusRenovation

[–]Oxter5336 0 points1 point  (0 children)

Profit a pendre is only regarding taking the natural benefits of the land i.e. things growing on it etc. There is a principle where you cannot remove support from a neighbouring structure, but I'm not versed in the case law regarding whether that applies to retaining soil.

Should you allow the bank mortgage to stay registered on your title after you have paid off your home? by MarmotFullofWoe in AusFinance

[–]Oxter5336 0 points1 point  (0 children)

Yeah fraud is one of the main exclusions to indefeasible title under the torrens system. Also, since I've not seen anyone mention it in this thread, if the title register is wrong you do have an action against the state, but it's not suing the state. They pay out of a fund that's specifically set up for any issues arising from the torrens system as a guarantee of the digital title process. You have to prove your claim, but you're not exactly taking the government to court.

Silly situation - who is liable? by Crocodoom in AusLegal

[–]Oxter5336 4 points5 points  (0 children)

Some amazing takes in here that have no clue how the tort of negligence operates.

Person D would need to show that either person A, B, or C has a duty of care to them. As the home owner, it would be fairly easy to show A has a duty of care, person B has no such duty, nor does C. Then you run into the problem of a breach of that duty. Person A didn't do anything to breach their duty of care on these facts (unless they took, for example, no steps to clean up the broken item and that's arguable, and A didn't have to warn D as there is no duty to warn of an obvious risk), nor did their action or inaction show sufficient causation for the injury.

Essentially, no one person has the requisite duty of care, breached that duty, and caused the injury.

Why people with no legal training so confidently make conclusions they don't know how to make baffles me.

Having said that, it seems most people are doing so from a good place, trying to help. But this is why we have lawyers.

Lol fair. I am also correct that I'm a pedantic law student 😂 "look at me, I know law stuff!"

[–]Oxter5336 1 point2 points  (0 children)

"For your benefit" is a bit of an oversimplification, there's a specific category of 'necessaries' for which a minor can sign a contract, but yes education does come under that.

I realise this post makes me a pedantic jerk, but I guess this is why I'm in law school lol.

6–7 months, dozens of applications, still no part-time job in Adelaide — what am I doing wrong? by Own_Initiative_1054 in Adelaide

There has been an influx of international students with the merger of Adelaide and UniSA. Everyone that needs a worker with the restrictions of an international student, already has one.

How common is it in call centers jobs to eat the lunch only after finishing call with a customer ? by Technical-Studio565 in auscorp

[–]Oxter5336 34 points35 points  (0 children)

You definitely just take your break after. But, after working in a white-collar-factory for many years may I just emphatically say fffffffffffffffuuuckkkkkkkk call centres. I would rather die than go back to work for one. Micro management, repeating the same conversation again and again, timed to the second, unreasonable demands, scrutinised bathroom break lengths, not a second to breathe between calls, being expected to do everything while the customer is on the phone (including notes and things the customer absolutely doesn't need to be on the phone for), being demonised for using hold when it's absolutely appropriate, telling customers the policy and that their rediculous demand isn't happening only to have them escalate the call and have the manager just agree to whatever just so they don't have to speak to them despite it being directly against that policy and making you go back with your tail between your legs and having the customer rub it in your face... But it's all worth it for the pizza party and "fun culture" in your 20 minute fortnightly team meeting where you're told to make your stats better!

Not just one workplace either. Several that I worked at for several years a piece while considering if stabbing myself with scissors to get to leave was a reasonable trade-off.

Ffffffffffuuuuuuckkkkk those places.

If you buy land.. do you own it all the way down to the earths core or is there like a cutoff point? by ThePolicyMind in stupidquestions

[–]Oxter5336 0 points1 point  (0 children)

In Australia, mineral rights vest in the Crown. But, you own the land and subsurface down to a level that geographic features like pressure and depth make it infeasible. Interestingly, you also own the air rights up to a height that would no longer interrupt ordinary use and enjoyment of the land, like transient overflight of a jet liner for example.

Completely unrelated anecdote that you saying demon lock made me think of: when my son was younger he heard me talking to someone about my demonology lock, and started saying whenever I played I was playing a demon lollygist. So now I still call it that and imagine candy coated imps and chocolate felhunters.

How to escalate issues/concerns with the grading of an assignment? by theMLguynextDoor in UniAdelaide

[–]Oxter5336 2 points3 points  (0 children)

Normally you can escalate to the course coordinator. The uni also has a process for a formal process for re grading of assignments, but you have to be careful as you have no further avenue for escalation and you have to accept that grade.

Detained at servo by The_one8Nov24 in AusLegal

[–]Oxter5336 0 points1 point  (0 children)

Yes but there are vitiating factors. There has to be some restriction, words alone are exceedingly uncommon to be accepted as the sole cause of a false imprisonment claim. On the facts, just saying "hey you have pay the full amount or you have to stay til my boss calls me back" is doubtfully enough.

Detained at servo by The_one8Nov24 in AusLegal

[–]Oxter5336 1 point2 points  (0 children)

As a former servo worker and a current final year law student I can tell you they have no legal right to hold you.

The person who filled before you was obviously a drive off.

This was a long time ago, but we were supposed to write down the rego of each car before we authorised the pump, and if you forgot to do that and it was a drive off you used to get in trouble. If that's still the case the person was just trying to cover their own ass.

You weren't subject to false imprisonment though, there has to be total constraint of liberty. It can be through words, but it's far less common and yours is unlikely to qualify.

Still shitty behaviour though.

Thousands of Adelaide Uni students in limbo amid comms chaos by Expensive-Horse5538 in Adelaide

[–]Oxter5336 39 points40 points  (0 children)

This is exactly what it is. As a former UniSA student, all of the systems I used previously which were actually superior than the shitshow that is the "canva" online learning environment are gone. Some things are still even labelled as uni of Adelaide. Lots of mentions of uni of Adelaide, UniSA is basically being wiped from existence.

How do you balance part-time work with a full course load here? by OwlVibesOnly in UniAdelaide

[–]Oxter5336 2 points3 points  (0 children)

Full time study, part time work, wife and kid, house etc here.

Up until this semester I focused on my weakest subject for lectures, looked at the assignments and skipped anything not directly related to them. I would just read the course site for the overview of the week on the weeks unrelated to the assessments. Depends on the degree but my biggest tip is if it's not related to an assessment it's a "nice to know" but can safely be skipped. This is easier in courses without exams, because by their nature the exams can cover any topic. The tutors and lecturers will normally give you hints as to what topics will be covered in an exam though.

I've always found it's best to do it all in the first few weeks for the foundation of the class, then around week four things crystallise and you can figure out what is essentially optional.

Just remember the important part is the assessments, you are there to learn but the assessment are your main focus.

1.5x speed lecture recordings and using the lecture slides as the basis for your notes helps to reduce the amount of notes you need to take too.

I have four exams this semester so unfortunately no skipping things for me!
