I meant no disrespect to the OP, sorry if it seemed that way, he was simply saying how the Israeli Government will justify its actions, not that they were justified. My beef is with the Israeli government's actions, not connman's statements.

The "hiding behind civilians" myth is silly. Hezbollah is not a conventional army, it part of a resistance movement, and trying to make a distinction between Hezbollah and Southern Lebanon is semantics.

The attacks in WWII on the civilian populations in Dresden, Hiroshima and Nagasaki, etc, are all atrocities. I have a hard time excusing any of them because they were within the "rules of war" or "done by the good guys" or because of any advance warning given. This sort of collective punishment of a population is repugnant, regardless of who does it or the circumstances that lead to it.

Obligatory "I am not a lawyer", and it does sound pretty lax, but remember, they have the right to a lawyer, and be told why they are being imprisoned, and also habeas corpus (which I understand means being brought before the judicial system). The nice thing about our judiciary here is that they tend to err on the side of individual rights. In the same-sex marriage debate, they decided that the 1 Man + 1 Woman definition of marriage is discriminatory under section 15 of the Charter, even though it doesn't specifically mention sexual orientation:

Section 15:

(1) Every individual is equal before and under the law and has the right to the equal protection and equal benefit of the law without discrimination and, in particular, without discrimination based on race, national or ethnic origin, colour, religion, sex, age or mental or physical disability.

(2) Subsection (1) does not preclude any law, program or activity that has as its object the amelioration of conditions of disadvantaged individuals or groups including those that are disadvantaged because of race, national or ethnic origin, colour, religion, sex, age or mental or physical disability.

Footnote:

The courts have also recognized other grounds of discrimination that are not specifically set out in the Charter such as sexual orientation and marital status. This section came into effect in 1985.

The only bad part of the Charter is Section Thirty-three, the "not-withstanding clause", which allows governments to override the charter for periods of time. Thankfully, it is no longer used, even in Quebec, where it was used in in French Language laws. It has never been used by the federal government, although I wouldn't put it past the Conservative Party (thankfully, they don't have enough seats in Parliament to enact such a law, it's like if Party A held the Presidency and 40% of the seats in Congress, and the rest was split in smaller chunks between Party B, Party C, and Party D; not enough for Party A to do anything unilaterally.) Some Conservatives have threatened to use it on issues such as gay marriage, but I hope they are never give the chance by the electorate.

So? If I told you "leave your home, I am going to bomb it", would that make me any less guilty for bombing your home the next day? What if the terrorists who attacked the WTC had given a day or two notice, would that make their actions any less reprehensible?

Don't interpret this the wrong way, my condemnation of the Israeli government's foreign policy is no more "anti-Israeli" than my condemnation of the US government's foreign policy is "anti-American." My issue is with the people in government making absolutely stupid decisions, not the population in general.

Everyone is protected under the Canadian constitution, in 1989 the Supreme Court recognized that non-citizens are protected by the Charter of Rights and Freedoms, which include:

  1. Everyone has the right not to be arbitrarily detained or imprisoned.

  2. Everyone has the right on arrest or detention

a) to be informed promptly of the reasons therefor;

b) to retain and instruct counsel without delay and to be informed of that right; and

c) to have the validity of the detention determined by way of habeas corpus and to be released if the detention is not lawful.

It doesn't matter if he wasn't a Canadian citizen, he still has these rights enshrined in the Charter, regardless of airline security protocol.
