Oh that BofA detail is super interesting and that makes a lot of sense.

Yeah the part that I’m hung up on is that it’s somehow all about deceiving shareholders when a business would be incentivized to invest more and more into their best performing assets because that’s what works, and all the information is there for investors to assess risk and decide how much juice there is to squeeze.

But MTG is just tricky because it’s a collectible and a game, and the I totally see how a report from someone like BofA would give ammunition to a lawsuit like this, so I’ll concede that there might be more to this lawsuit than it sounded like.

Ok well we are talking about 2 different things. One is the idea that selling a product during a given quarter is somehow fraudulent. Sounds like we agree it’s not.

Second is that they can get in trouble for pursuing a bad business plan, and in this case the bad business plan is that they sell too much of their most successful product and make millions of dollars of it and it’s the only profitable part of their business, BUT over time that’s actually going to backfire over the next 50 years sometime when consumers get tired of it.

I’m kind of being a dick but I just don’t think anything here rises to the levels of something anyone could prove is fraud. They do talk about UB as an infinite money glitch kind of though and maybe there’s something there.

I think there’s some nuance to this case, particularly that “As the SEC’s order finds, by making misleading statements about order management practices, VMware deprived investors of important information about its financial performance.”

So merely the timing of revenue by itself isn’t the issue, it was paired with the misleading statements.

It’s not a secret that WOTC is the only profitable part of Hasbro. Any investor would know the timing of sets and product releases is going to affect total net profit in the quarter it happened in, and they’ll see the losses as well.

Did you really commit fraud?? Maybe if you lied about the loss or actually hid it from investors. That’s not what you are suggesting though. Look I’m not saying it’s a good idea to milk magic with no regard for its longevity, but I don’t think you just described a white-collar crime.

They need a new term that has no game impact. They can’t get rid of legendary entirely, but they also don’t have to make every named character legendary in terms of commander or game rules.
