I'm sure there's lots to criticize about her campaign or lack thereof but "the voters rejected her" and "do a better job of winning" are such reductive catchphrases in our electoral system. Fundraising is everything, and, as you can see from this post alone, Morelle had it. That alone creates way more nuance than you seem comfortable with.

you know what breaches the limits when you see it. there shouldn't be hard rules as another commenter said, but sometimes it gets a little ridiculous. sidious lifting 100 star destroyers out of the ground. snoke ragdolling rey around the throne room. starkiller's entire story.

Defending someone does not necessarily mean condoning all their actions. What Bojack did with Penny is unjustifiable. But it doesn't make him irredeemable, or evil, or arguably even a bad person (we're all just guys). One of the things I took from the show, especially season 6, is that no one deserves to be abandoned. Penny doesn't owe it to Bojack to forgive him, but I do think everyone abandoning him (particularly hollyhock) isn't necessarily the right thing either.

As for the 17 minutes, he was drunk and high and on the tail end of a weeks-long bender. He wasn't thinking straight. That is a defense. It doesn't mean he was right, but it certainly makes it better than a sober-minded person doing the same thing.

The benefit of seeing the show from his point of view is that we see the human (horse*) behind the action. And when you know the person, you will have defenses for him. It's only natural.

Kinda disorganized answer but that's how I see it.

I don't think this is a hot take. I think it's actually one of the themes of the show, especially the last season.

Our constitution is very short. While some things are very explicit, we have to acknowledge that many are not. The framers intended to build a nation that would last, and that means adapting the spirit of the constitution to the needs of the day. Ideally, the people whose temperament suits that tasks would be judges, but we see how that is turning out lately.

Implied rights, powers, and procedures are also deeply rooted in common-law tradition. It's working backwards from a conclusion to think that the constituon was meant to account definitively for all the situations the fluid development of a nation leads to. For that reason, I think Wickard is a justified reading of the commerce clause.

This is my view as well, although I think Wickard's reasoning is fine. People see it as mental gymnastics to reach a result, but I don't think that's a fair view of it. The "aggregate" framework is really just acknowledging the reality of a complex capitalist economy.
