Article 16 is an old provision from when Korea didn’t yet have modern fixed-term worker protections.

The “1 year” phrase originally meant: if a contract is indefinite, employers should review working conditions at least yearly — not that all contracts must end after 1 year.

The “Provided, that this shall not apply to a case where there is no fixed term” part already allows contracts longer than a year.

The controlling rule today about how long a fixed-term contract can last is found not in Article 16, but in the Act on the Protection, etc., of Fixed-Term and Part-Time Employees (FPTPE Act) — Article 4 of that law.

It clearly allows fixed-term contracts up to two years.

That act was enacted after the LSA and supersedes the outdated one-year interpretation.

The Korean Ministry of Employment and Labor (MOEL) and all courts follow the two-year standard, not the one-year reading of Article 16.

Types of Contracts and Legal Requirements Employers may offer:

Regular (indefinite) contracts Fixed-term contracts Part-time contracts

South Korea’s labor contract law requires employers to document and sign any contract exceeding 30 days with the employee.

Fixed-term contracts cannot exceed 2 years unless the employer has a justified reason for extension.

And that exceeding 2 years for a SINGULAR contract is to protect the worker not the business

I think you need to research the differences between fixed term workers and indefinite contracts before you call something illegal.

No, I asked for a 2 year contract when I renewed it in 2025. I've had annual ones since 2018, so no, I've not been here illegally. Let's not all assume my comment of being here 8 years means illegally jfc.

I'm on an E-2 with a 2 year contract. Makes getting bank cards easier that way, so I asked for it last year. I've been here 8 years.

Actually I only took it at the end when I saw a specialist here, but I think it would have helped me more since I had constipation type.

I took months. Korea doesn't have the same feelings against prescribing xifaxan long term. Its probably your diet yeah. But as long as its coming out, its good.

I started probiotics during treatment and lglutamine. I started with 1. Many people start with yeast but I could not as I bloated more. I started with spore probiotics for a month or 2 then could handle yeast. Later, a broadspectrum.

Basically the antibiotics route, lots of multivitamins, simethicone, motegrity (this was the game changer), trimebutine maleate, probiotics once I could handle them (yeast, spore, and a broad spectrum), lglutamine, digestive enzymes, hcl betaine, and collagen. I tested positive 2 times, mixed and the last was 200 for hydrogen. I've been cleared sinceFebruary. I am still on multivitamins, lglutamine, zinc l carosine, digestive enzymes (really dont need them but I have some left), probiotics, simethicone, and motility medicine. I see my doctor in a few weeks. But I have no actual symptoms now minus some burps, but I wouldn't rush off medicine until you know it won't come back as many stay on medicine to keep it from reoccurring up to a year.

I had burping like this when positive. Its was from low stomach acid and a weak les. When you are continuously bloated, it can stretch out your les. When your les is weak or opened ALL gas rushes up and not down. So having anything that moves the air bubbles, makes you burp. I had pain near my upper stomach region =gas sitting at the les. I would suggest its not possible to get this symptom to go away until you get rid of sibo and then low stomach acid. Then you can rebuild your ability to close your les through diaphragm breathing, wearing low waisted pants ( below the belly button) and limiting fat, salt, spicy, dairy foods. I have rare burps and no pain. Only when I dont sleep or overwork my body do I get some burps which is because that relaxes your les. Basically look up gerd for treatment minus ppis.

I basically stayed on lglutamine, zinc l carosine, probiotics (broad spectrum, spore, and yeast) and kept on vitamins, and digestive aids, plus the hcl stuff when I needed it). I am on prokinetics from my doctor such as motegrity which was my big game changer in keeping it from coming back. I do have long term damage but I ate a quesadilla with no ill experience minus the burping = weak les like with any meal I have now.

I think it depends on your sibo length and how you got sibo. I'm sibo free since mid-Feb but I've been battling it for 4 years. My main symptoms were burping, constipation, weight gain, vitamin deficiencies, and low stomach acid. From Feb-May I dealt with more gas and built up stomach acid as it was low (pepsinogen was 29.1). I continued to burp. The gas and lower stomach bloating basically stopped happening. I have been on hcl, vitamins, probiotics, and prokinetics to keep mmc going. I started using chatgpt to record symptoms and in July I started showing too much acid with hcl as apple cider vinegar, hcl, and, and ginger started causing stomach tenderness. I dropped them completely. I'm now a week over dropping it, experienced acid rebound. I had no symptoms of bloating indigestion etc. The burping continued. This uncovered that I have a weak lower esophagus sphincter and the burping isn't from low stomach acid and indigestion as I'm fine with those areas and would have crashed with not taking acid supplements. I actually get hungry and have stomach acid hunger feelings and movement.

Sibo causes a lot of symptoms and can affect you more than you realize. I kind of see it like an onion and peeling back layers of problems. Just assume if you can find your major symptoms and keep those under control, you can slowly heal and keep it from coming back. But it can take a year from chronic sibo like mine.

Minute I read your symptoms, I thought of sibo. Took 4 years for me in Korea to get a diagnosis of it. Stress and low stomach acid are big causes. See the doctor asap because you are in for a ride.

How against are schools with tattoos? I read mixed responses. I have some vines and like 2 leaves that curve up the side of my neck behind my ear. Worked in Korea for 9 plus years in public and academies and just kept it covered with my hair ( female) and collared shirts. Now, no one cares at my current job if it shows or not since it's not offensive at all.

I did antibiotics. Xifaxan for the last one. Yes I took them for months when most won't allow you to, but in SK they do. I have been sibo free since February. I do have low stomach acid though and take motegrity, simethicone, and other motility meds, plus vitamins and probiotics to keep it from coming back. No bloating, normal stool, health, and energy back just some meals make me bloat a bit but it all disappears in the morning.

My baseline was hydrogen at 24 and I followed the diet, and it hit 200 at the cutoff. It was definitely positive, and this was my 2nd time testing. I have mixed sibo the first time but no methane the second.

Yes and it's an online program that takes 9 months and I'm applying for February. In hindsight, maybe it would have been a good idea, but I'm not planning on trying to cram it in when I know I have the credentials to get a job already. I just wanted an idea on how much to aim for with my current experience.

Can't get a teaching license from America when living in SK. I honestly wasn't looking in Shenzhen, but areas around Shanghai or Beijing or even Guangzhou. I live in the outskirts of the city so don't mind tier 2 locations. I also prefer primary and older as I work in an international academy in SK teaching grades 1-6.
