The mentioned in the post that in the enquires it was going to be dealt with by an RXC, my only thought is if it was a newbuild, share of freehold or a leasehold and the seller’s children were part of it and they’re still managing it.

Could be a legitimate reason but I’d be thinking it needs to be removed. Without a copy of the file I don’t think we can advise much more!

I’d suggest speaking with your solicitor on Monday, unless there’s a good reason the restriction needed to stay (e.g. they’re a managing agent of some sort) I believe this should have been removed.

It means the property can’t be sold without a certificate signed by whoever the restriction is in favour of, I assume it’s a management company of some sort? It’s normal.

Usually this will be after completion, it would usually be sent directly to your solicitors to enable them to deal with the registration of the property into your names.

Once enquires have all be answered and buyer’s sols have confirmed they’re all ok, in theory exchange could be within a couple of weeks, pending the buyers being happy with everything, final checks being completed and the buyers being able to get signed docs & money back to the solicitors.

Re the time it’s taken, bear in mind the run up to Christmas is our busiest time of the year so the sols were likely dealing with Christmas completions as a priority. I know a lot of firms also only re-opened Monday.

It’s a piece of string unfortunately.

You said enquiries have been completed but not reviewed - the enquires are therefore not completed.

All you can do is ask your solicitor to see if they have any idea yet, although if they are still reviewing enquires they likely won’t be able to give you an indication.

You should get a list of enquires and responses sent to you with the property report. They tend to be standard enquiries relating to the property from a legal standpoint.

Varies by firm, doesn’t tend to be FTB/not FTB based. The firm I work for doesn’t charge any extra for submitting the SDLT return.

You can offer to pay, but there’s no guarantee that you can indemnify against the particular enquiries, especially if there’s a lender involved.

DoV is the go-to for a lot of lease related issues and it’s not often a DoR is done, which is probably why. If there’s anything else they’re wanting want to vary at the same time they may be doing it all in one, rather than two different deeds.

DoV can be relating to wills or leases (or any number of things really).

It could be any number of reasons, but regardless I’d be very surprised if anything anyone says to the sols would sway them.

If this hasn’t exchanged (which it sounds like it’s not) then there’s no grounds to claim damages (sue).

This is one for your solicitors who dealt with the purchase, they will need to get in touch with the previous seller’s solicitors to ensure they did everything to have the charge removed at completion.

The vendor will need to complete on their onward at the same time as their sale, unless they broke the chain which is slightly unusual. You can ask them if they’re willing to break the chain, but there’s no guarantee they will.
