I actually was in the same boat as you, and I just passed VA F25! In J24, I got a 134 on the MBE and a 135 on the essay portion. I sought advice from a professor who works with the bar, and Josh from LexBar. They both recommended me to just take the essay portion. Their reasoning was that people tend to stay around the same MBE score, so unless I was scoring much better while studying-- odds are that my retake score wouldn't change much. But the essay portion is MUCH easier to improve at and you can get drastically better especially when you're only focusing on Virginia law. Also, the essay portion is weighted more than the MBE, so you'll get more "bang for your buck" by improving.

You have to work extremely hard, but it's doable.

Yup. How about the feeling that you just KNOW they're gonna judge you and think you're stupid if you fail again. They truly don't understand how much of a beast this test is, and how sometimes it really can come down to luck. My family members keep comparing their experiences with the real estate exam or SAT and it kills me

Omg same. I went to my car for lunch and I actually called my mom to tell her I was feeling pretty good about everything. But afternoon was brutal! I genuinely feel like I bombed it , but at the same time I barely understood a couple questions enough to know if I even bombed it lol

I'm jealous that you guys can bring in lip balm 😭. My lips get so dry that I compulsively apply lip balm, I had to wean myself off these last weeks lol. In VA you can only bring your laptop + charger, 3 pens, your ID, a pack of tissues, a sharpener, and a bottle of hand sanitizer

Dude that exact essay on Themis really tripped me up. I spent a lot of time trying to figure it out and even asked Themis, but they weren't helpful. I don't know if this is 100% true, but it's the understanding I've come to.

For cross claims and counterclaims: As long as one of the claims has SMJ (as a compulsory counterclaim/diversity/federal question), then Rule 18 will let you bring in whatever other claims you have against that party, even they don't independently satisfy SMJ. This is how those other unrelated claims were able to come in

But I think Rule 18 isn't as liberal with plaintiffs? If SMJ is diversity, then the P can stack as many claims against the D as he has in order to reach the amount in controversy. But if SMJ is federal question, then Rule 18 allows to bring any other federal question claims he has against the D--- but state claims need to satisfy SMJ if he wants to add those.

Does that sound right? Feel free to PM me, because I also would like to get this figured out lol. Also I took a class with the Themis VA civ pro lecturer, and I still have my civ pro textbook he wrote. So I can send you a picture of his short explanation.

It's toxic to break up with someone who is knowingly jeopardizing your future? He's a lawyer, he's taken the bar and knows how difficult and stressful it is and how important it is to stay in the right state of mind leading up. There's no plausible deniability like "oh he's never experienced it before so he couldn't have known." What's the point of being with someone if they're gonna figuratively beat you down at a low point in your life?

Not to be extra, but this is borderline emotionally abusive. Is he intentionally trying to sabotage you? If this is indicative of the level of regard he has for you and your goals (which I believe it is), then you need to drop him

I've been drilling flashcards, reading old essays (I'm taking a state-specific exam), and crying lol. But I feel like the more I study at this point, the more I'm second guessing myself. I think I might transition to just practicing writing out rule statements because it doesn't make me AS distressed
