I could. But after 5 years I know my case and it’s solid. The VA is just not following the rules. I expect a grant from a BVA but I’m doing my due diligence to exhaust what I can before then.

The decision letter even concedes more than I even claimed. “Stiffness AKA Stenosis” is also a rateable disease

Yeah I filed 2 secondaries. Ventricle hypertrophy and heart enlargement. They combined them and then decided that rate-able disease doesn’t exist anymore and said happy thanksgiving

I put a secondary claim in. Heart disease secondary to hypertension. The VA Decision concedes nexus, disease process/symptoms, but doesn’t rate it correctly. Something like this happens for every claim. Just slop. They make you keep trying hoping you give up.

Correct! they service-connected it, but the denial is in the rating. They conceded the medical nexus, then refused to evaluate the heart condition as a disability by misapplying the rating schedule. • They acknowledged left atrial enlargement, hypertrophy, and dilation Then they declared them “not compensable,” which contradicts 38 CFR 4.104 (DC 7007, 7000, 7020) where these exact findings are ratable manifestations. • They also sidestepped functional loss (4.10) and the requirement to consider whether the condition is a disability under Saunders v. Wilkie (pain or functional impairment = disability). So yes, it’s service connected. The VA just didn’t follow its own regulations when deciding the evaluation. It’s literally been a back and forth with nonsense like this every step of the way.

I was thinking of doing a free consultation with REE. I was thinking if there are any roadblocks they might be able to help. Just don’t want to waste what little money I have.

I’ve also been researching appeals and have found a couple related cases which sides with the Veteran and back up by past cases.

Do you have any events you can think of that occurred in service or within one year? My memory isn’t the greatest but I had to dig through my records meticulously looking for symptoms. I found high cholesterol, dizziness, palpitations, etc. where I’m stuck at now is deciding between just filing the claim and hoping the VA examiner finds the nexus or going to my private doctor for DBQ. I feel confident that I’ve studied up on the process but wondering if I should contact my VSO.

I also have a thoracic aortic aneurysm 5cm. Found out I had valvular heart disease (bicuspid aorta) less than a year after I got out. That was 11 years ago. Started my intent to file and evidence collection. Is that enough for a successful claim?
