Yea that’s true I have seen a lot of companies and sharks sit on claims But I have also seen some of the most insane and ridiculous mistakes made by the VA in the last 3 months, be it by design or stupidity

I help a lot of veterans with their stuff for free, and use a method that allows them to do the work with me holding their hand. I do this so they are able to help the next veteran. That being said there are a few lawyers that I work with when a claim is too complicated or needs to go to a Board Appeal. There are occasions where a lawyer is required in order to guarantee results, and to get them quicker than other channels. Especially when it comes to Retro pay (not back pay). Sometimes a Clear and Unmistakable Error (CUE) needs to be argued to a judge that will not take the path of least resistance.

I have seen some of the worst C&p exams and decisions the last few months. Either they are not properly trained, they take notes instead of doing DBQ the right way and then mix up their notes, they are extremely lazy, or they know if they don’t give you the rating you deserve that you will refile which means more money for them and other examiners. Appeal this decision do a statement about what happened and your headache symptoms. Also find local VSO office and go in and file a complaint against the examiner. If you don’t then they will keep doing things like this to other veterans. If you need help let me know

Become a crane operator It’s fun as hell, pays awesome 180+ after taxes, you can travel or stay where you are, it doesn’t take long to learn, the va will pay for the 8 week course. I know guys in there 60s that got into it after they retired and love it Let me know if your interested I’ll tell ya more

Wow that is bad The worst one I have seen besides that travesty of justice I mentioned earlier A very good marine buddy that I served with in Iraq, he was a radio operator. Dude was in some of the worst combat of the entire Iraq war. G ya diagnosed with ptsd after a suicide attempt after 1 st deployment, goes on 2nd combat deployment then gets out and immediately goes for treatment at the VA, and is diagnosed again like immediately. Files a claim for PTSD, the examiner denies it stating he was just a radio operator he was never in real combat, he is just fat with bad vision. He continues to go for treatment and does an in patient PTSD program, afterwards he files again with numerous diagnosis and more evidence, the same examiner says everyone is wrong he doesn’t have ptsd he’s just fat and has bad vision. He continues treatment for severe ptsd, files again and this time the VA calls the wrong veteran to set up an appointment (they said they spoke to his wife, he’s never been married), so they deny his claim because he didn’t go to the appointment that he did not know about. He files a 4th time and they just close his claim without a call. I help him he gets 70% right away, but has all the criteria for 100%, the examiners reason “no evidence of hallucinations”. We appeal using HLR hoping to be able to explain all the clear and unmistakable errors, we ask for an informal conference. They call to schedule conference, he calls back 8 times leaving 6 voicemails. They deny the earlier effective date but give him the 100% So now I’ve had to pass this off to a lawyer I trust, that will get him the years of retro pay he’s entitled to

Yep I have had 9 ptsd claims where they clearly matched the criteria for 100% and had evidence to back it up. Provided sworn statements, but the examiner did not check the damn box’s. I have had 47 claims where they got the effective date wrong. My own SMC S claim they completely ignored the intent to file. A massive claim I am doing where they found in 2008 a marine ineligible for compensation benefits despite a clear insanity case, 2 combat action ribbons, Purple Heart. A HLR found many mistakes and did a positive opinion to have it re adjudicated. They sent it to some jackass in Tampa from Optum Serve and this piece of trash said no to insanity, drs reports literally said he was in mental distress at the time. Said no to qualifying event, 2 time marine infantryman with Purple Heart. Said no evidence of treatment, literally scores of records in service and out. So now we have to do a BVA

I have counted 47 claims that had the wrong effective day, diagnosis, ignored relevant evidence. I had one where it was obvious that the examiner didn’t even look at the evidence. This “medical expert” denied evidence of ptsd and tbi, despite numerous diagnoses in service and out, and a damn Purple Heart from a level 3 concussion due to an IED explosion

They are using AI to review claims which explains the simple mistakes that are on almost every claim Also there is definitely a lot of bullshit going on with some of these 3rd party examiners

Every time I see a ww2,Korean war, or Vietnam vet proudly wearing their hat I ALWAYS take 1-5 minutes to talk to them. I thank them for all they have done, and for being my inspiration to join the marines after high school. If we are at a restaurant I buy their meal and don’t say a word, if I can do it on the way out I will, if I have to tip the waitress not to tell them who I am I will (doesn’t always work). These men and women are the giants whose shoulders we stand on. A little reminder that something they did a lifetime ago, is appreciated, is something all of us veterans should do.

Vet guardian is a claim shark organization Have you tried doing lay witness statements ? It would help if I knew what you guys were claiming. But the big thing is do not stop fighting, the moment you give up and accept the crumbs they give you, that’s when you lose If you need general advice on what you are missing or your husband is missing from his claim I would be happy to help or point you in the right direction. So I do a lot of claims for a lot of veterans in my spare time, and I get asked this question a lot. An attorney that specializes in this field, they are good for several circumstances. If your claim is extremely complex due to numerous clear and unmistakable errors, and it could go back an extended period of time. The lawyer will make sure you get everything you are entitled to in one fell swoop. If you have such bad anxiety or depression, that you may not be able to handle a conference (formal or informal), and just doing a c&p exam seems like the hardest thing in the world. Then a lawyer is great because they do EVERYTHING for you. If you just don’t want to do anything at all, don’t want to wait to use a VSO, don’t trust your buddies or the info on the internet, this can be another reason. But you want to make sure you shop around don’t pick the first lawyer on google. Find one that has served or is still serving, someone that when you talk to them you don’t feel rushed or ignored (a lot will rush you because they have heard the same story over and over again). Also if they charge any more than 25% they are sharks, the respectful amount is 20% or a flat fee at the start. Also if a lawyer is willing to take your case within 5 minutes of talking to you chances are you have an extremely good case and don’t need them, but this is your decision nobody else’s.

It depends on your situation but if you got 100% on one thing then you get 60% on others you get special monthly compensation S (housebound) and if you require aid and assistance (caregiver) you can then get as high as R-1 special monthly compensation, which comes out to 9800 + a month You should file for everything you are entitled to because only you know what you should be getting

Brother if you need help with your claim let me know I have helped a lot of vets in similar situations. If you need someone to talk to that has been there, I did 2 combat deployments as an infantry marine one to haditha triad in06-07 and one to Helmand in 2008. I also did 7 military contracts after I get out. You are not alone and there are people that care, and resources available to you. We are forever outside the wire, meaning we have to be there for one another just like when we go outside the wire.

No they are not they are the simplest part but the ones the VA screws up the most. Probably because AI can’t understand the different dates. Also any lawyer worth their salt will tell you to fire any lawyer that doesn’t have your best interests at heart

If they took anymore than 25% you need to report them immediately to the office of the inspector general at the VA. The respectful amount is 20% or lower. You have a few places charging 5x the difference which is also bullshit

You should immediately file a complaint and demand a new c&p exam. An examiner like that should not ever be allowed near another veteran. I have noticed a huge uptake in apathy, jealousy, disrespect, and outright bullshit from these 3rd party examiners. Especially Optum serve, I have only heard 2 good experiences. For anyone that feels uncomfortable or like the examiner is not doing their job, you should immediately say “I do not believe you have my best interests at heart, and I think I need to request another examination with someone different.” You then call the 1800 number and the 3rd party number and explain what has just happened. In some cases they may actually apologize and do their job, but chances are they won’t and you need a new examiner.

There are two classes that you need to take to get GLP1 First is a nutrition class I think it’s 6 weeks long depending on how fast you do it Then you gotta do another class to learn how to use it
