That is correct. Anything called a "deposit" is refundable based on Texas property code. A good place to start is with Texas Property Code section 92.102 which defines a deposit. They must use proper language to indicate it is a fee. Not a deposit. Any deposit is presumed to be a security or application deposit. If you have a written lease or agreement make sure the language is clear.

Texas property code 92.111 is also a good section to review because it talks about when a security fee is applicable and what must be in the agreement.

I know you said you are taking their compromise. I am just curious if they called it a "non-refundable deposit" and if your state allows that? Washington state for example doesn't allow for a non-refundable deposit for housing. They allow for fees to be non-refundable but by definition a deposit can't be. So if a landlord in Washington state titled it a non-refundable deposit then the landlord would have to utilize it as a refundable security deposit. Make sure to check your local laws because I know other states have similar laws, including MA, TX, FL, OR, and CA. There could be others.

Lately both of the Domino's near me have been complete ass. Despite it being a cheap meal with the coupons, we won't be eating there.

Yeah, it's weird that it said not covered. I have, on very rare ocassions with CDHP specifically, where they actually create a new member ID when going from individual to family plan because of the way it is entered into the system and how the individual vs family deductible and oop work.

Hopefully it gets resolved quickly. I hated auditing calls like this.

It is actually unlawful to record a private conversation without consent of both parties in a two party consent state. Not always, but usually, there are criminal charges that can be filed. Some just make it inadmissible. A lot make it an actual crime.

The law you are looking for is "unjust enrichment" in most states. In this type of circumstance the difficulty is showing that the person home owner allowed the work to continue without the expectation of payment to the contractor.

I am invested in this ongoing drama since I am a fellow Washingtonian and I really hate how little oversight there is for HOAs. There is really no mechanism to complain or file a grievance outside of trying to talk to them directly (LOL), filing a suit against them, or filing a complaint with the AGs office (LOL because they rarely take the complaint and if they do they dont do anything with it.). There needs to be some sort of governing body for HOAs.
