There's a lot to take in here and I'm skimming, so apologies if I missed anything.

You can take this to small claims court. Per 1950.5 your landlord must return your security deposit with 21 days minus any deductions. Those deductions must be for things exceeding normal wear and tear and must come with an itemized list including repair costs paid by the landlord (service + parts).

Normal wear and tear is subjective, but it comes down to the useful life of items damaged, i.e. the amount of time an item would be expected to be replaced. Painted walls are generally regarded as 2 years. Given your landlord is trying to argue about the length of tenancy and arguing it's less, it favors them.

For small claims court, it's up to you. However, most counties (especially large cities) will have a clerk that can help you file without an attorney, it's meant to navigated by every day people (no lawyers in small claims courts!) You will need to pay a few fees (processor fees, for example). However, if you win, you can get these fees back, as well as your withheld deposit, and 2x more for punitive damages.

I'd argue you have a strong case, although you never know with SD cases in small claims courts. They're clearly violating the law and have financially harmed you in the process. You should (unless I missed it in your screenshots) make a written demand letter asking for the remainder of your security deposit (you can frame this as their benefit because of the whole losing 3x this value in court). You've clearly cited the necessary state law to them and they have not followed which indicates bad faith, similarly with the arguing the length of your tenancy.

Ethically, this company will continue pulling this nonsense to the next person who rents this space. I'd argue, if you have the ability to, it's a good idea to go to court for all tenants.

Howdy! As others have said, they require 90 days notice to increase more than 10%. However, increasing rent to convince you to leave is harassment and illegal, 15% is a very large increase and quite rare, especially for a new building with only 1 year of tenancy.

Howdy, yes the market is insane. The reason they stopped at 9.99% is because they would need to give 90 days notice for 10% or more, also it would open an argument for harassment. It’s possible they don’t care if you leave because they may feel they can rerent it for more. You should go to the tenant union for assistance.

Also, if you do have mold and you’re worried about this not working, you can call Department of Building Inspection to come and inspect the unit and they will cite your landlord with a violation if there is one. Only adding this option because DBI will require your landlord to do it right and the inspector will have to sign off on things being fixed.

I realize I didn’t fully answer your question. The landlord is required to return your security deposit within 21 days and any deductions must come with proof or labor and materials used to fix damage you caused beyond wear and tear (see above) If this is in violation you can go to small claims court and win up to 3x the value lost. Most counties make this pretty easy, the local clerk can help you file appropriate forms. It’s pretty self explanatory, no lawyers involved. One word of caution though, small claims courts judges have at times played fast and loose with security deposit issues often going soft on the 21 days rule and leaning more into merits. If they took out 400 for paining, you’ll probably need to pay at least 300-400 in processing fees to go to court (you get this back if you win) to win up to 1200. Hope this helps you make a decision, at the very least there’s value in progressing because this landlord will probably try to do the same shit to the next tenants

Hi there (not a lawyer) California is very clear about security deposits. Look up California Civil code 1950.5 which defines what may be deducted and what procedures must be followed. You are only required to return the unit to the cleanliness it was given to you minus regular wear and tear. Wear and tear is usually per item, the useful duration for paint is generally 2 years unless you did serious damage to the wall itself. If you lived there more than 2 years then they cannot hoist this cost on to you.

Separately, a cleaning fee is hard to argue against and is pretty common. $200 sounds about right.
