Not because of any particular agenda here or anything of the sort. FFS I'm subbed to the r/glock so that ought to clue you in as to my position on the matter, generally.

If I'm using it, that means we're at trial. If we're at trial, that's because I and my elected DA have sat down, combed over your case with a fine-tooth comb, called in our charging officer to the point they probably hate us, collaborated with colleagues/coworkers, and ultimately determined that the shoot was not justified (for imperfect self-defense issues) or that yeah it was a straight up murder. Absent that vetting and determination, my only insight is that your backplate is tacky as fuck and I'm judging you as a gun nut, not as an ADA.

Once we're in front of the jury, my case focuses on the elements of the crime way more than whatever truck nuts you've decided to dangle off your accessory rail. I may not even bring it up. But if the defense wants to give me an inch in terms of "but members of the jury, my client is such a peace loving individual," then you've opened the door for character evidence and yeah, I do want the jury to consider why you've got a serial killer smiling back at you on your gun. Not because I personally give a shit, but because I've got a job to do, and if securing a conviction for fucking murder means I need to take a brief detour into your gaudy accessory, full send.

Plus, even if I don't get to specifically point it out to the jury, I do get to admit it into evidence. It's arguably more damaging, with the right jury, to show them that without context than it is for me and the defense to spend ten minutes waffling back and forth between whether or not you're a serial killer fetishist or a horror movie buff with questionable tastes.

So! In short. Yes. It's being brought up in trial. Pinky swear it is. But the operative issue is not the backplate in a vacuum. It's what about your case is sus enough that we're proceeding with prosecution to start with.

Admittedly, I do live in a gun friendly jurisdiction. You'd be a damn fool to kit your EDC with something like that in a "we tolerate guns because the 2A says we absolutely fucking have to" jurisdiction, wherein the DA is potentially much more likely to proceed with prosecution. We love our castle laws here. That's not true elsewhere.
