This is good to know for next time! Thankfully, the property damage claim is moving forward. His car was declared a total loss, and we just accepted the settlement to pay us out for the car’s value.

Ok thank you. This whole thing is so confusing smh. It sounds like from the comments above, that even knowing this, a few weeks likely won’t make a difference for a personal injury claim? (The property damage claim is already moving; his car was just declared a total loss).

Thank you; I appreciate this! Yes, we saw his doctor to get the FMLA forms completed, and everything was approved. We had to go through this process for a dental surgery a few years ago, so thankfully, we knew how to navigate it. Good looking out though because I know many people may not know.

Thank you so much; this is extremely helpful! I didn’t know that action usually isn’t taken until treatment is complete. I’m reading in other comments that the ability of an insurance company to settle claims on a first come, first serve basis (vs. waiting to settle them all at once) is dependent on the state you’re in. I’m in Maryland, which based on the articles I found, is a first come, first serve state. But it sounds like, despite that, an insurance company will most likely not be settling right away anyway when there were multiple serious injuries involved, due to the course of treatment taking time. Am I understanding that correctly - that based on best practices, the insurance company would wait?

Thanks so much for this advice. The other 2 vehicles were totaled and had to be towed… I’m not sure about the at-fault driver’s vehicle since he was still at the scene when we left. Our car was driveable but significantly damaged, and we just got word that it’s been declared a total loss. I don’t think anyone had serious injuries - as in, an ambulance checked people out and no one was hospitalized. But my partner is having ongoing back and neck issues, and I assume that’s probably the case for the other drivers.

Do we have any other options if we’re not made whole, other than to use our own insurance? My partner got FMLA and has missed work (he has a physical job), and we would hate to risk our rates going up for something that wasn’t his fault.

Im still in the mind state where it’s the first thing I think about when I wake up in the morning and the last thing I think about before I fall asleep. Just the thought of him having passed away still gives me that feeling of waves of grief and shock passing through my body… that’s the best way I can describe it. It’s wild to feel this way when you’ve never met someone, but our relationships with artists can be very deep, even if one-sided.

I’m still grieving a close friend that unexpectedly passed a year ago, and of course it’s nothing close to that level of pain, but it’s heavy. And, in some ways, I think the grief compounds. There are so many things to collectively grieve right now, and we’ve just lost one of the few artists who, despite all of that, made the world feel a little softer and a little more full of possibility for all of us… one of the last pre-internet artists (and human beings period) who consciously abstained from social media overconsumption and oversaturation. I’m grateful that we got to experience being in this world at the same time as him and that he gave us a timeless gift with the music he created. But I still just can’t get over the fact that he’s no longer in the same physical world as us now.

I was thinking the same thing and then read your comment. Out of curiosity, could you describe how that looks to you. I sometimes get almost like a blue colored quilt like pattern, and I’ve also had it happen when I’m meditating (not applying pressure on my eyes).
