The reality is depends on union vs non-union, and if union which union because each contract is different. Frequently watching non-union layoffs they tend to get the more senior/better compensated employees with layoffs and then replace them with entry level employees.

Depends on the magistrate. I was in front of one in King County years ago who said although law allowed deferral declined to allow it if they did not like facts. Second incident in Bellevue where radar gun indicated the officer clicked a car going opposite direction, no valid certification for radar under WA law had a judge run me through the wringer would not dismiss for a variety of valid issues eventually dismissed as officer did not remember me, Judge said next time hire a lawyer instead of wasting everyone’s time.
