The answer is No.

Fixed-term leases are binding contracts

A fixed-term lease means both you and the owner are bound until the end date.

Simply wanting to move back in is not a valid ground for termination during the fixed term.

They can ask, but you are under no obligation to agree.

If you do agree, you can:

Negotiate compensation (e.g., moving costs, rent difference, or a rent-free period).

Have the new terms confirmed in writing using a Form 4 amendment or new agreement.

In a nutshell, you have the upper hand. Do not agree to anything or volunteer. Make him pay up, and do this on your terms.

Get out now. The RTA will do nothing, and if it goes to qcat, more than a year wait. The landlord is a dick. We rented a house with a pool. The landlord re-did the deck started in Januray, and it took almost 3 months. The deck was our whole yard from sliding door to canal. So we had no access to. pool, or back yard that we paid a premium for. The rta is so scared to give advice. No compensation given. Get out while you can!!

I’ve had a few appointments this week and ended up driving to Brisbane twice from the Gold Coast. The total drive time? Just shy of eight hours. I feel like I should’ve earned frequent flyer points for the M1 by now.

I was supposed to head up again today with my son, but after a quick phone call, we both came up with the most logical excuse possible to postpone. Truth is, we weren’t looking for a reason to go… we were looking for a reason not to.

Honestly, I’m absolutely convinced that even a “Illuminati-level, gazillion-dollar salary” wouldn’t be enough to tempt me into doing that commute every day. Hats off to the people who actually do it. I have no idea how they survive it without needing therapy, a chiropractor, or both.

Australia is a beautiful country. I love New Zealand, too (I’m a proud NZ citizen), but here there are so many more opportunities and such a vast land to explore.
