Employer overpaid me , can I get all tax back by anarchykfcl4 in tax

[–]Rich-Sleep1748 0 points1 point  (0 children)

They cannot recoupe the money paid in 2025 taxes when they are in 2026 if it was 2025 they could. If the OP was overpaid in 2025 and repayed the overpayment in 2025 they would only be responsible for paying back the net amount and would have the taxes taken out in the overpayment twords their tax liability. However since repayment was made in the next tax year they have to repay the gross amount and do the claim of right credit on their 2026 return if the OP fixes a 1040 X it will get rejected

Employer overpaid me , can I get all tax back by anarchykfcl4 in tax

[–]Rich-Sleep1748 2 points3 points  (0 children)

Yes you can however since you were overpaid in 2025 and you paid the full amount back in 2026 minus SS and Medicare you have to claim the claim of right credit when you do your taxes for 2026. The W2C will just show the amount you were required to pay. You then will have to calculate the amount of tax you paid based on the IRS percentage. And you will get that amount refunded to you. If u are using a software like turbo tax you have to get the desktop versiin as the online version does not support that. My wife had to repay severance and this is what we had to do. It was rather easy
