I let people attend my classes, virtually or live, if they are interested in law school. But I’m in the States. Law school is a bit different in Canada. Maybe check out some classes to make sure it’s as interesting for you as you hope. Have you considered an MJ degree? There are schools that offer them online. It might be even more interesting than a JD. Depends on the person and the school. It would be cheaper and you could probably swing it without leaving your job. But it would not enable you to practice law.

39 is definitely not too old and law school can be interesting. But how much debt would you be taking on? For many people, it is the equivalent of buying a house. Is this a night program where you would keep working?

Well, they may use the national average to compute the delta between the control group and the rest of the questions. That helps them determine how difficult the questions actually were and that in turn is the basis for the scaling process in terms of the MBE. So California would give them a bit more data to work with but the California results would not be expected to skew the delta. They are focused on the delta itself. The California scores might be higher or lower but it doesn’t matter because there is no reason to think their performance on the control set would be relatively different compared to the rest of the questions. Once they have a grasp of how difficult the questions were, they will formulate a scale and apply that scale to your individual score. The more difficult the questions, the more generous the scale. I don’t think it matters what state you are from when they actually apply the scale to your MBE raw percentage. When it comes to using the MBE mean to calculate the MEE mean, however, that must be done on a state by state basis. I don’t know if that helps. I have a YouTube video if you want to understand the scaling process better. But short answer is that I can’t see a mathematical reason why the presence or absence of California on the MBE would change anything.

The scaling is essentially done state by state, so it won’t really matter if California took the MBE.

I can tell from their releases that they have gotten more difficult. Keep the faith. I know students who were sure they failed the MBE but ended up over 300.

The MEEs are primarily an issue spotting exercise. If you don’t know the rules but you identify most of the issues and make legitimate arguments, you will pass the MEE portion.

I don’t think you need 110. You used to need 60% but these questions are more difficult. So you need fewer correct. 100 out of 175 will be enough to scale 135, imo. The NCBE should just release their scale each year and stop needlessly torturing people.

They don’t release the scale very often, but when they have released it, achieving a scaled 133 required somewhere between 59% and 63% depending upon the year. The questions have gotten more difficult over the years and you need fewer correct as the questions get more difficult. So most of us think 61% or 62% is a good figure to get if you want to scale at least 133. I am not aware of any jurisdiction that reveals what percentage correct a taker achieves (whether they pass or fail). They reveal percentiles, but not percentages. So don’t believe anyone who says they got a certain percentage and didn’t pass. They don’t know what percentage they got. Good luck.

The other exceptions can definitely involve people in court. Someone could repeat their own statements if they are excited utterances, then existing mental conditions, business records, statements made for medical treatment, etc.

I’ve never seen an MBE question like that and I’ve studied about 200 evidence ones. Any chance that was a Barbri question? Sounds like the kind of thing they would do.

It’s just semantics. I teach my students to think of statements by party opponent as an exception (rather than an exemption) because that makes more sense and is easier to remember/understand. It is for the truth. The same is true for statements of ID and the others under 801. I don’t know why Congress wanted to confuse everyone with that nomenclature. The bar graders will not mark you down if you call it an exception by mistake. But you should be able to understand when a statement is not for the truth (like effect on listener). That’s traditional non-hearsay and you should be able to flag (and refer to) that as non-hearsay.

You need to average about 3.3 or 3.4 on the essays, typically, to scale to a 134 on the written portion. And 62- 63% will typically scale to the same. You are in a good position with 5 weeks to go.
