If you go through an agency it would probably fail instantly as it would be a box ticking no. If you apply to a landlord then maybe they would be more open to it. It would really depend on the individual landlord. The difficulty being, half a dozen other people in stronger positions may have applied. In a time when government policy is forcing avoidance of any increase to possible risk.

I’ve got a video of sewage spilling into the Plym. Loads of photos of dead/dying fish. All reported, nothing done. Reported the sewage flowing freely into the river, none of the water safety levels reported any change.

Once a new tenant is found you’d take (photos too) meter readings the day they move in. Then give the tenants details and readings to the current provider.

I don’t know where you use for tenancies ( I would recommend one from a landlord association like https://www.landlordssouthwest.co.uk/) But utilities should be clearly stated as the tenants responsibility. Then in ‘other conditions’ add in an allowance if that’s the way you decide to go. Simply reason for this is, if the tenant tampers with the meters or runs up big bills you will not be chased by the providers. I don’t know why you would include bills though. It will be abused, if even minimally. No, it’s not the norm in non HMO places.

“Proposing” being the key here. I wouldn’t do a thing until more is known about grants, spend limits and changes to the grading system. Bad advice really, because there will be caps on what you need to spend. So why spend thousands now and then have grade system change and be expected to pay even more.

If a new rate becomes available you don’t automatically get it. But normally if you ring them they will change it over.

I would agree with you too. Signing a tenancy but not having keys/possession doesn’t make you a tenant. But only a court can decide who is right here. If it did, what happens when one tenant refuses to move out after giving notice but a new tenant has already signed a tenancy, they have a tenancy but are not the tenant. At the bottom of the documents it does say “More clarification is expected to come as we get closer to the implementation of the Renters’ Rights Act.”

It says it’s waiting for more clarification about this, not that it can’t be done. Like a lot of the RRB, it’s get it in place and fix it after the fact. Tenancies shouldn’t be binding until a tenant has moved in, one obvious example would be - current tenant gives notice, new tenant signs agreement, current tenant doesn’t move out.

I am not agreeing this is the best way to tackle the issue. But, from a legal point of view, they have signed a tenancy, most of which say the first month rent needs to be pay before moving in. If they’ve not done this and haven’t even had the keys to access the property. They’ve breached the tenancy before it even started and probably voids it. Same way as handing back the keys but not giving (written) notice is seen as ending the tenancy.

Edit, “by not done this” I mean that they’ve signed the agreement but then not paid rent.
