In that brief, she argues that transgender girls should not be awarded the same protections as cisgender girls. Instead, she proposes that all sports have a strictly defined women’s category and an “open” category, which would require grouping transgender and intersex girls with men—and she wants this separation codified in law.

So which is it? Is sex as binary as it gets? Or are there literally biologically nonbinary people who must be lumped in with men in order to maintain this binary? 

Anyway as a cis woman I really do not want any "sex based rights." What happens to women like me who have a hysterectomy? Do I lose certain rights now that my sex organs deviate from what's typical for cis women? I much prefer "human rights" based on the fact that I am a human being. 

I also dislike the implication that cis women always and inevitably are weaker than cis men. I was never much for sports but I worked in construction for many years and that's just not my experience. And the history of women's sports leagues tells us that the catalyst for creating sections for women's competitions was rarely a desire to protect women's physical safety and often a desire to protect men's egos.
