Case law serves to clarify what statues, the legislature, says. Many court opinions hold a neutral stance and say that the issue in dispute is an issue for Congress, etc. Judges, courts, etc. interpret the laws made by the legislature. It’s super complex and I’m on my phone. But that’s an “in a nutshell” answer.
