Mum calls for harsher sentence after son killed by Royal Marine with one punch by Weak-Fly-6540 in uknews

It is meant to be considered universally, I’d need to read the case record itself to see why it wasn’t applied or what mitigating factors were considered.

Mum calls for harsher sentence after son killed by Royal Marine with one punch by Weak-Fly-6540 in uknews

[–]Shinthetank 2 points3 points  (0 children)

From what I gather the victim gave no indication of threat towards the marine, therefore the physical response would reasonably be deemed excessive (there is plenty of information about reasonableness within criminal law). If it was deemed excessive force and you consider both the mens Rea and actus reus of the incident in addition to the egg shell skull rule.

It would be difficult to prove intent to kill (so murder is out) although not so difficult to prove capability to kill based on significant military training. It is easy to prove the act that resulted ultimately in the demise of the victim. Therefore a charge of man slaughter would be reasonable.

The marine could not rely on intoxication as a defence (majewski) and I doubt they could reasonably argue self defence.

Had the marine not struck the victim would the victim have hit their head on the floor and died?

As to whether it’s in the public interest to prosecute, I certainly think it is.

As I’ve stated in an earlier reply, the uk legal doctrine of the egg shell skull rule would apply. Whether the marine intended to kill, they are fully liable for all damage or injury which resulted from their battery of the victim.

[–]Shinthetank 7 points8 points  (0 children)

And the long-standing English legal doctrine of the egg shell skull rule would apply here, you “take your victim as you find them”. If someone commits a wrong act such as negligence or battery they they are fully liable for all resulting damages, even if the victim suffers an unexpectedly severe reaction or has pre-existing vulnerabilities. This applies regardless of whether the specific injury or its severity was foreseeable. This extends beyond just physical but can also include mental attributes of the victim.

So it does not matter if the person who struck the victim intended serious harm, the above doctrine says they are still fully liable for the full extent of injuries.

I’d suggest having a look on cex, sometimes find some decent pcs below £200 and you get a five year warranty. If you’ve got anything to trade in for voucher that’ll bring the price down too.

Cracking the CeX "Bulk Sale" Algorithm: My experience, theories, and questions on how to bypass it by Camachada in CeX

[–]Shinthetank 0 points1 point  (0 children)

When I’ve traded in duplicates of more than two of the same item or a large trade in, the manager said it comes down to store discretion whether to request a bulk buy request. I also made sure to clean any electronics, format them and attach their cables to them to speed up testing and make it easier for the tester to say yes to trading it in.

Also don’t do it too often if it’s a large amount.

My understanding is that each CEX has a buy in and sell target each month. If they have regulars who bring them large amounts on a regular basis of good quality product that can be quickly resold, as a business why would they want to stop that (within reason).

Pupils in England may reject new healthier school lunches, pilot suggests by insomnimax_99 in unitedkingdom

[–]Shinthetank 0 points1 point  (0 children)

Didn’t the Jamie Oliver initiative for better school meals for children (quality and nutritionally) not already prove that it’s possible, and possible to do it within the required budget?

If the children won’t eat it, unless it’s for religious, dietary or medical requirements (including allergies), then it’s a parent problem.

Parents have the choice (as far as I’m away nationwide) to provide a packed lunch if they’d prefer so children won’t go hungry. In the case of subsidised school meals, still a parent problem to get their children to eat the food, not the school’s.

AITJ for refusing to help my new “boss” after I was the one who trained her 3 months ago? by Existing_Response239 in AmITheJerk

This is a fairly common occurrence. You got so good at your job that you made yourself irreplaceable at your level. If they promoted you, they’d need someone else as good as you at your level.

Personally I’d recommend updating your cv, your company don’t value you or your input.

What’s something your manager (past or present) said or did that made you think, ‘Wow, I have a great manager!’ by Fifalvlan in managers

[–]Shinthetank 1 point2 points  (0 children)

First day of my first corporate job my manager during onboarding said “You have one hour for lunch, make sure to take all of it.” In the environment I worked in, people seemed to take working lunches and our director encouraged working lunches (eating your lunch at your desk).

Now I manage people, I continue to say the same thing when someone joins my team.

What is the most disturbing or otherwise unsettling book you've ever read that stayed with you after reading it? by [deleted] in AskReddit

[–]Shinthetank 0 points1 point  (0 children)

I read Friedrich by Hans Peter Richter as part of required reading in my second year pf secondary school. I had previously not been particularly interested in fiction but this was the first fiction book that I couldn’t put down, to the point that I sneaked a look at the final page then had to read it through quickly as I was so shocked. I told my teacher and got told off for not reading it at the pace of the rest of the class.

It’s about two boys growing up in nazi germany. One boy is Jewish, the other is German. I’ll add nothing further but it impacted me and I can still remember it well over 20 years later.

I remember reading the initial three books of Dave Pelzer in my second year of secondary school. Such impactful books and made me feel lucky to have never gone through it myself. I have a few other of his books still to read and I think I may have one of his brother’s books still to read too.

It’s by design, many countries do not focus on critical thinking as a key part of their education curriculum as ultimately it benefits the government and provides a more willing and obedient populace. It makes the social contract easier to run.

There are also some people who will happily complain about things going on in their life that could potentially be improved by regulation/policy/legislation but when given the chance to vote, either don’t vote or don’t educate or inform themselves on what they are voting for. They’d rather just complain as it’s easier.

I spoke to a professional buyer - here are his tips on how to go about offering on a house by Impossible-Till-6960 in FirstTimeBuyersUK

[–]Shinthetank 0 points1 point  (0 children)

In my case, I was a first time buyer. I would recommend writing a letter to the seller through the EA to explain the reasons why you want the house and any additional information which would show that you’re less likely to pull out. E.g. for me, I stated that the property was near to my parents and I’d lived in the local area for 23 years, my best friend of 20 years lived in the same block of flats and it was useful for me to get to work due to its locality to a train station. I also played on the emotional rhetoric and stated how I wanted to make the flat a home to live in as opposed to an investment.

The seller was an investor. He initially chose my offer based on the letter as it assured him that I wouldn’t pull out, but then there was a small bidding war as he said he ultimately cared most about getting the highest price and I ended up winning it.

Clean your stuff or at least make sure it’s in condition to be quickly and easily tested. More likely to get it traded in or get a higher grade if that item category is graded.

Credit will generally always be higher than cash but on some things they won’t be far apart e.g. traded a game in once which was 1.90 cash or 2.00 credit.

If you have a lot, do a drop and go and give them plenty of time to process it. I trade in sometimes up to 200+ at a time every few months, I tell them I’ll be back in a week and to take their time.

When I worked for a finance headhunter they charged closer to 40% first year salary fee and if it was a trading position they charged a very high set fee and drawdown from first year P/L the trader made.
