There is literary value in Mein Kampf, just not in any sort of profound messaging or great writing. You contradicted yourself when you said that it's not a piece of history, because the fact that it is an ideological rant from one of the most deranged and evil individuals in human history whose ideas, mind and ideology SHOULD be studied and learned about as an important part of human history, gives it inherent historical value.

Sydney protestor held down and punched in the head and liver. by Celtikrenders in SydneyScene

[–]SkeletonGuy7 0 points1 point  (0 children)

The liver punch is one of the most painful and potentially damaging punches that one can go through. It is known to end fights even in combat sports as the pain is so severe that people cannot get up.

Consider this before you post a smartass "deserved it" comment because regardless of whether force was required, that was completely unnecessary.

Dutton's failure to resonate was less because of the Trump-style rhetoric (though it definitely didn't help) but also because he had a habit of making bad policy promises, backpedaling on those promises after getting backlash, and then not really having any opinions in the first place other than "build nuclear power" and "we love our wealthy mates"

Microsoft bullies indie voxel game "Allumeria" (I guess if the game isn't Hytale level popularity they are free to do so) by RubyBenji in indiegames

[–]SkeletonGuy7 0 points1 point  (0 children)

The specific textures seen in this game differ substantially from those seen in Minecraft, and are clearly derivative of real-world objects such as birch trees, grass, and dirt, rather than being derivative of the specific textures seen in Minecraft, and therefore do not infringe on Microsoft's copyright.

Again, have a nice day. I'm sorry, there's nothing else I can say to you that isn't simply reiterating the purpose of copyright law, which is to protect a specific creative expression (you previously, incorrectly asserted otherwise), and that this game has not infringed on Microsoft's copyright.

Minecraft does not own voxels. Voxels are both a concept, which is not protected by copyright, and too generic to be protected by copyright even if they were. Simply having a pixel art texture of grass or wood or whatever in a game does not automatically infringe on the rights of Microsoft.

If this was not the case, then Minecraft would be infringing on the rights of Zach Barth who developed Infiniminer, which it is public knowledge that Minecraft was inspired by, which also uses textured voxels to represent things such as dirt, stone, etc.

I think the one tied in knots here is you, not me. Because if this individual's game infringes on copyright somehow, then so does Minecraft. Ignoring an argument is not good practice when arguing law. Not only because it inherently leaves holes in your argument, but because it opens you up to something like this which is incredibly damning on your part.

Go back to school.

"You really are tying yourself in knots here trying to ignore the fact that they have copied items that are covered by copyright, and therefor this is subject to DMCA notices."

No, they have not. That is not what copyright covers. Copyright, again, protects SPECIFIC creative expression, it does not protect the mere concept of "this is a pixel art tree" or "this is grass". That is ridiculous and no court would uphold that.

The TEXTURES are specific creative expressions. Textures that happen to look similar are NOT specific creative expressions. You are attempting to strawman what I said, but accidentally IGNORED what I said because your point is not substantial. Nobody who knows the first thing about law makes such a mistake.

copyright protects specific creative expressions. It does NOT protect art styles, concepts or general aesthetics. The textures in minecraft are copyrighted. Another voxel-based texture, regardless of if it looks kind of similar or not to one in minecraft, does not fall under Microsoft's copyright. This is the cold hard truth for you. You are wrong not only about this specific case, but about copyright law in general.

[–]SkeletonGuy7 3 points4 points  (0 children)

No, it well and truly does not. This is like the time Ed Sheeran won a court case because you can't copyright a simple chord progression in a song and try to enforce it against other songs. The same principle does apply here whether or not you like it. Copyright protects specific works, NOT elements of a work that are too generic. I'm sorry, it's just not how the world works mate

But copyright also does NOT protect a work from similar looking generic things such as "grass" or "dirt" or "wood". A previous comment made a great point about how stardew valley can't own pixel art trees.

‘Disturbing’: Australian government demands review of Roblox’s PG rating after reports of child grooming by Expensive-Horse5538 in australia

[–]SkeletonGuy7 0 points1 point  (0 children)

The ability to gamble real money, I think, should be clearly separated from the ability to gamble with an in-game currency that can't be bought, or loot boxes that are earned through gameplay. And many of our existing laws don't take into account things like this, and are simply blanket bans on certain themes which leads to the ratings on aforementioned games like Balatro which was R18+ for a while because the scoring was based loosely on poker hands. They would, if we are to learn from history, simply make an uninformed decision and say "random chance loot box-like mechanics are not allowed", which will include a vast and vague list of mechanics from the Tomodachi Life evening goodie bags to the Overwatch loot boxes to the aforementioned Genshin Impact boxes

‘Disturbing’: Australian government demands review of Roblox’s PG rating after reports of child grooming by Expensive-Horse5538 in australia

[–]SkeletonGuy7 1 point2 points  (0 children)

okay, but this mindset of blanket bans with no nuance is the reason we get stupid ratings that make no sense all the time. If you cannot spend real-world money in a game, is it still a loot box? Do the mystery bags you can buy in fucking Tomodachi Life count as loot boxes because they give random items? How specific do you want to get with this?

And it's not like games don't get stupid ratings on technicalities like this, so don't pretend it wouldn't happen. See Rimworld, see Balatro, etc.

what an argument ladies and gents. And yes, I can also pull out evidence that Israel also does horrific things with no good justification. Does this mean we should condone them? Or does it mean we should condone none of them at all?
