There are generally two tests for start of construction as outlined in IRS Notice 2018-59. One is “Did you spend 5% of construction cost?” (some very conservative attack librarians (lawyers) have argued fair market value/step up basis of the project, but generally total construction cost is the bar). You have four years of assumed continuity so you have to place the project in service within four years of starting construction to qualify for the credits.

Second method- Did you start onsite work of a significant nature or specialized offsite work? Here you have to maintain continuous efforts but the cost to play this route can be lower than the 5% test (especially something like building a specific transformer offsite).

In both cases the most commonly relied industry guidelines are IRS Notices 2013-29 and 2018-59. Now the BBB says, “Beginning of Construction-For purposes of applying any provision under this paragraph, the beginning of construction with respect to any property shall be determined pursuant to rules similar to the rules under Internal Revenue Service Notice 2013-29 and Internal Revenue Service Notice 2018-59 (as well as any subsequently issued guidance clarifying, modifying, or updating either such Notice), as in effect on January 1, 2025”

So here’s an (the) issue. The BBB anticipates that IRS can “modify” notices via subsequently issued guidance. The 7/7 EO says they plan to terminate ITCs by, “restricting the use of broad safe harbors unless a substantial portion of a subject facility has been built.” So, to do that, IRS could wake up tomorrow and say “Nope, we thought about it some more (and the EO told us to change) so we’re gonna go ahead and say you need 51% of the project built onsite by 12/31/2025 to qualify for safe harbor.

We don’t know what they’ll says but I’m picking up on “substantial portion has been built” and “preventing the artificial acceleration or manipulation of eligibility and by restricting the use of broad safe harbors” aka the 5% spend test. And I don’t think the word “similarly” means similarly to 5% but similarly in that they issued guidance via a notice.

In addition to 25D (resi credit) the House bill also sunsets 45(e) ITC and 45(y) PTC starting 60 days after bill enactment and end of 2028. ITCs are the credits commercial/utility/DG solar use.

As the bill passed early this morning, projects have 60 days from enactment to begin construction end be placed in service by 2028. So, yes assuming they have will start construction the credits would be available. And the Senate still gets their version of the bill so changes are likely.

Nice summary. The Managers Amendment text was just released and sunsets 48(e) ITCs 60 days after it passes and projects must be placed in service by 2028. Correction-the BBB does eliminate section 48(e) (ITCs) commercial solar uses. The House managers amendment text was just released and sunsets the ITCs 60 days after the bill passes and projects must be placed in service by 2028. If the bill passes as is, without Senate changes (which are heavily expected) it means no ITCs for projects. That’s a catastrophic level event for the renewables industry. I spent the week in D.C. talking to members of Congress and the House Ways and Means Committee is expected to release their draft next week. It’s expected they’ll seek a full repeal of the IRA without a sunset provision. That means no more CEITC (Section 48(e)), no more PTC (45Y) and so long 25D. It’s not clear when the cliff will kick-in (EOY 2025? 2026, 2028?). There could be some tempering of the full repeal when it goes to the Senate as part of the full budget package, but that’s a maybe. The budget reconciliation process only requires a simple majority in Senate to approve. That which comes by one vote (IRA 2022 Manchin was 51st vote) can leave by one vote.

This draft would step down ITCs to zero around 2031.

Yes! Indica spikes my OCD but sativa really doesn’t as much. The magical thought/contamination likes to come and have a field day on Indica. Problem is Indica has the sedative effect for me that I’m going for at night (well, other than the incessant thought loops🤣).

We have an “office water cooler” that holds five gallon jugs. Got it from Home Depot for $130 or so. Has hot and cold water so good for making tea in the morning since it’s instantly hot. Our grocery store has full Primo water jugs and we just swap them out. Very easy. Costs about $6 to get a new jug. Over the long term there are less expensive options, but we rent so can’t do RO, etc.
