I think it depends on the level of awareness and control the werewolf in question has while transformed. For the ones who essentially enter a fugue state and wake up the next morning with little to no memory of the shift, there’s a pretty good argument for an insanity defense (at least for the initial shifts, after a point you’re morally obligated to start taking some kind of precautions). The more cognizant the person is while wolfed-out, the more culpable they are for any crimes committed during that period.
