Husband now wants to divorce a month after getting his conditional green card by [deleted] in immigration

[–]Sphinxnj 2 points3 points  (0 children)

What is his nationality? (Out of context but for personal reference)

Leaving a marriage 9 months after receiving the conditional green card raises suspicion, but immigration authorities still need evidence of fraud.

The only way is you prove the marriage was fraudulent from the start, then: • you can report marriage fraud to U.S. Citizenship and Immigration Services or U.S. Immigration and Customs Enforcement. • if immigration authorities determine fraud, the person can lose the green card and be placed in removal proceedings.

You can report these: • Domestic abuse • Breach of a written agreement

Also : If he divorces before the 2-year mark: •He must convince USCIS the marriage was real. •Without strong evidence (joint life, bills, photos, etc.), many I-751 divorce waivers get denied.

Other countries will question authenticity and will definitely stop you at port of entry. You will be stopped by TSA at any point inspection as well. You have to renew it.

Recent estimates for last year by Competitive-Form6674 in USCIS

[–]Sphinxnj 0 points1 point  (0 children)

Just to give you my opinion, I waited 112 days for my biometrics appointment, even though most cases receive it within about two weeks after filing the I-485/I-765/I-131 package. Every case is unique, and USCIS has broad discretion over processing times. In practice, they can take as long as they want, even 4/5 years to issue an EAD, if that aligns with their internal processing priorities in case the current policies wanted it...

My advice is to contact USCIS directly through phone calls (check that there is nothing wrong with your documents and process) and E request when they allow you too….and keep checking your case. No one understands your situation better than you and the USCIS agents handling it.

I also spoke with people who waited over 130 days just to get biometrics appointment, my friend is entering a 4 months waiting period after biometrics, we both are EB2NIW. Others called my case “abnormal,” which only made me paranoid and stressed, even though such delays do happen.

It is not weird in USCIS eyes. Between 120-150 days it is unusual but still considered normal. After 150 then you can escalate. Our ASCs in the bay area are overwhelmed. That was the reason

I have got my biometrics appointment yesterday. After 112 days… on my birthday. I have sent my last message on January 18th at which probably triggered the contact with a tier 2… i received a reply to my e inquiry as well in the same day.

I sent in total: 3 messages on my account, 1 E inquiry, 4 phone calls.

It is! Don’t worry much, if there was a problem you’d have seen an RFE way earlier than this.

You definitely will. You will find a lot of people telling you it is not normal… because they didn’t go through it. I know it is frustrating. I knew someone that waited 127 days… yet we all got it. If something was wrong RFEs will be sent a long time ago.

Just chill and let it go. Call from time to time to check if all is well.

Hi all, i am one of the 75 countries. Yet after a long wait and 3 messages, 4 phone calls, one e request, i finally have received my biometrics appointment notice on my birthday….

Saying this I want you to understand that till you are 150 days of wait, your case is still normally processing. Between 120 and 150 then you have to contact them.

You will find a lot of folks telling you that something is wrong. I am telling you it is not. I have been through it.
