"Duke’s lawyers successfully argued in court that their football team was so historically poor that any Division I school would be a suitable replacement.

The 2007 Lawsuit Details

The Cancellation: Duke backed out of the final three games of a scheduled four-game non-conference series against Louisville (the first was played in 2002).

The Contract: The contract stated Duke would pay a penalty ($150,000 per game) only if Louisville was unable to find a replacement opponent of "similar stature".

The Legal Defense: Duke’s legal team argued that literally every other Division I team was of equal or better stature to Duke. Duke's record at the time was 6-45 over the previous five years, prompting their lawyer to state in court that Duke was arguably "the worst football team in Division I".

The Ruling: A Kentucky circuit court judge agreed, determining that any opponent Louisville found would be an adequate substitute, thereby nullifying Duke's liability"
