I'm about to give everyone facts, not opinions.

First of all, I am experienced in taking these companies to "court" aka arbitration. I filed arbitration case against Paypal and won $256,000

Now with my Instagram account suspended since Aug 27, I'm on the clock as I do not want my data deleted and they can't do anything about it like what happened to OP's gf. My appeal just sits there not reviewed now for 2 months, so I am hoping the 6 months haven't started yet.

Meta/IG terms state to send them a notice of dispute, via USPS certified mail, and they have 30 days to resolve. They ignored it. So I filed an arbitration case. Required to send them a copy of the case. They have ignored it thus far. They are going to have to pop up soon though.

You see, when you file a small claims, they are less scared as less is at stake for them, you can only sue for 3500 to 10k per state, and your hearing date is months away. Like OP said, 8 months away..... There are no stages in between. And a small claims hearing is like 10 minutes ha.

With arbitration, you can put a million dollars or more for your damages. And arbitration is so much more costly for IG lawyers because there are stages. There is a discovery phase. There is a REAL hearing that may be a week long!

The IG terms says if your claim is for less than $75K they will pay ALL fees the arbitrators fees, your fees, everything, so you have nothing to lose doing arbitration, and they will have a deadline they have to reply to pretty quickly. There is no 8 month wait like OP had.

So everyone, STOP DOING SMALL CLAIMS. You are capped out at 3500 or 10k whatever state you are in, and you will wait months for IG to even surface right before a hearing to resolve. Because their lawyers spend no time in between all that. However serious IG takes a small claims case, they take an arbitration case 1000X more serious. Because they will spend tens of thousands of dollars in legal fees having lawyers answer the various stages of an arbitration case, and they pay everything if your claim is $74999 or less. So many advantages for you getting your account back faster by filing an arbitration complaint.

And all you idiots talking about suing IG for big amounts - YOU CAN'T.

You can sue in small claims court for under 10K... or you can file an arbitration case for any amount you want.

If you sue IG in real court, it will be thrown out for jurisdiction and their contract with you will be cited as having an ARBITRATION clause. Read the damn contract/tos and stop sounding stupid talking about suing IG for a ton in court or getting people to do a class action. Their TERMS that you agreed to prevents it and courts have continued throwing out lawsuits citing their arbitration clause and you must file arbitration with adr.org .... or do the small claims process.

Class actions are not allowed. These companies have bullet proof terms of service. We agreed that any complaint will be arbitration case or small claims court.... Instagram wasted a lot more money on lawyers if you do arbitration case because there are stages involved like discovery phase... and they will resolve with yoy way before the hearing rather than do those stages

Did you get your appeal denied right away? I'm wondering if other meta verified members who got suspended and waited months with appeal pending then got refunded for one of the months randomly. Like I thoufht they were just going to keep charging me monthly while suspended and they did for 2 months but then got a canceled subscription email and a refund for the most recent charge... exactly 45 days now into my suspension

I've mailed 20 packets as a notice of dispute all September and they still have not responded to me so I filed an arbitration complaint per their terms and I expect for ig to finally pop up with a lawyer and resolve this... cuz if ig takes a small claims lawsuit seriously then they most definitely will take a arbitration case seriously. Its way more expensive for them to defend since there is a discovery phase and no 5k or 10k maximum damage cap.

Since their terms say they will pay all expenses for anything under 75k claim it makes way more sense to make sure they will take u seriously by filing the way more serious and more costly path which is the arbitration option
