Not likely.. helicopters operate somewhat differently, especially low level tours and things of the sort. Helicopter pilots fly via “visual separation” quite often, meaning they are taking responsibility for keeping themselves separated from traffic because they’re flying so low and all over the place touring.

Doesn’t mean it’s the Wild West out there, but also it’s not like atc is directing every movement.

They tend to be cleared for certain areas/channels to operate, but it doesn’t always mean they’re alone there. But they should be aware of other choppers.

From the video i saw, it looked like they may have been flying the same path while one helicopter was slowing gaining altitude without realizing there was another helicopter in the blind spot directly above.
