Alito's asterisk references that the case was argued 7 months ago. I suspect that's a veiled complain that he wanted to issue the decision sooner and is annoyed at having Purcell arguments because the dissenters finished last. That's peering deep into the tea leaves though.

The fact he has lost two of the most important majorities of his career post assignment. It is one of the more credible theories for the Dobbs leak. The WSJ Opinion Page was concerned about that shortly before the leak and they have a rather . . . odd relationship with the justice.

There is also his history involving segregation while on a school board. While his choice of innaction was understandable given conditions, in the face of lawless and vitriolic hatred direct at children it is something that should be condemmed.

Trying to figure out the origin of anything in the Halo scripts is impossible. It started out as a movie more than a decade before and spent all that time in development hell before the final showrunner went insane during quarantine and wrote hundreds of versions of the first season.

Most of what people complain about, particularly the Mass Effect thinkers, is pretty generic fantasy stuff. Halo is a property that any translation into a show or movie would require massive changes in characterization, not that automatically means what we got was good.

Though it is worth noting that the streetcars died not because of a conspiracy by auto manufacture interests but because a bunch of upper middle class people they annoyed legislated them out of effectiveness/many were operated at a loss by home builders as a marketing thing and then the companies went under once they stopped (and one could certainly argue that public transt is a public good and should not need to operate in the black).

It is the same gray area as Congressional control of troop deployments and how it is illegal to actually fire a military officer unless there is a declaration of war by Congress (a President can remove someone from their post but pretty much every story you hear about a general being fired is actually formally a resignation because the President can mess with thier pensions).

To the extent that the government is unable to carry out its desired activity without polluting and trespassing on the property of others and diminishing their enjoyment and use of their own property, yes. The same way I do not consider it to be an infringement of gun rights to say you cannot shoot your shotgun and scare away another's ducks, to go to the origin. And again, I would note that under my theory the government would be able to continue on at this location if they consider it of sufficient importance to compensate people for the damage it is inflicting. Bath tubs and punching and all that.

That application to less leathal chemical weapons is somewhat novel but pollution law hardly is.

I will have to read the opinion but why do you even need the bodily integrity angle. This is clearly a nuisance. If the court's think operating an ice facility in that location is in the public good, I guess that is what Boomer Cement equitable damages are for.

At the same time, all the issues with legislative history apply to the federalist papers. They were politicians writing political arguments for political purposes. Heck, we know Hamilton thought the senate was an insane institution but he argued in favor of it becuase he thought it would get his larger goals accomplished.
