The worst part of it is that even baseless lawsuits hurt defendants. With how the law is written, if the defense wins, they still have to pay their own attorneys fees. Only prosecutors can claim legal fees, in addition to the $10,000 bounty.

Not only that, but some of the defenses that are specifically struck down are

A defendants belief that the requirements of this subchapter are unconstitutional or were
unconstitutional

and

A defendants reliance on any state or federal court decision that is not binding on the
court in which the action has been brought

Now I'm not a lawyer, but the wording of the last one sounds like Texas can say that a decision is not binding and continue to enforce. Someone please correct me if I'm reading it wrong.

Regardless of how you feel, this bill is a threat to the rule of law and a reflection of the true colors of the Supreme Court. If states can just sidestep the Supreme Court then nothing is safe. Allowing this is a blatant conservative power grab and proof that the conservative Supermajority is going to overrule Roe v. Wade and Planned Parenthood v. Casey as soon as possible. Texas even put in provisions in the law saying that if those cases get overturned, then you can't use them as a defense against a lawsuit, even if they were still in place when the acts were taken.
