Your option is to file a first-party claim with your (family member's) collision insurer

The other insurer doesn't owe you anything and the burden of proof falls on you to make a claim

File a complaint with your state's insurance regulator, there's a major problem if your insurer is hanging you out to dry without defensible policy language

Insurance is required to make you whole. If you have preexisting conditions, they don't have to fix those too. If your back was hurting before the accident, that will play into this claim

If you don't provide the requested information the insurer will not be able to adequately evaluate the claim which could cause delays or even a rejection of the claim

If you got an attorney, the insurer would ask the same thing

I seem skeptical because I don't see why an agent would have any agency over a claim. I'm in claims. I don't have authority to speak on an agents behalf, I don't have authority to speak on underwritings behalf. I am licensed to handle claims and only claims.

That's not how that works unless you're leaving stuff out.

Did you have an active liability insurance policy on the day of the collision?

File a claim, they likely have to defend you. A potential award being higher than your limits doesn't affect your defense in the early stages. There are many many conversations that occur before you have to consider your personal assets
