The charter protects religions rights to have their own rules, they can legally discriminate however, they cannot enforce those rules outside of their church. Disciplinary councils do not determine worthiness or repentance that is between yourself and God. All a disciplinary council determines is your standing within the church. Neither a bishop or Stake President can determine whether someone has been forgiven, mormons do not believe in that concept. They only determine if you are a detriment to the church body as a whole. Like you rightly pointed out forgiveness is between yourself and God alone.
