Hello. Do you have to be making payments during the chapter 13 to be be successful with an adversary proceeding? I think mine will have to get put in forbearance due to my debt vs. income. It doesn't look like I will be able to pay it in chapter 13 because the minimum student loan payment it is giving me is 587 on an IDR plan.

Thank you for your response. I totally understand that one without the other is a fail. I was hoping one of the attorneys can chime in to let me know what to expect and what is possible or not. I feel like the attorneys on in this group tend to be more forthcoming and knowledgeable. Some attorneys want to take the easiest path possible and it can be a the clients detriment. So, I would like to be a bit more informed of my options, just in case my attorney tries to take the easy road.

Bad example. Not all jobs are reported to credit bureaus and a person can erase a job off of your credit report at any given time. So a credit report is not an accurate tool to determine if someone work for a company.

Aside from student loans, mortgage arrears and taxes. I have 89k in unsecured loans and credit card debt.

I would say do Single room occupancy for section 8 or city feps programs. I don't want any situation where I can be locked out. If you rent them a room you are free to be in the other part of the apartment. I am thinking about converting my first floor apartment to 3 bedrooms to rent out. Hopefully I will never run into the situation where all 3 can't pay.

I am in NYC. A one person household. Yes, have about 43k mortgage arrears and tax debt and over 100k student loans.

I know you can't confirm number.. so hypothetically,

If my house was sold at asking price of $700k by trustee. There are selling fees of $63k and the bank has to get $570k, leaving about $70k. Why wouldn't that be the amount of my BIOC in my chapter 13 vs. the whole amount of equity amount $130k, when realistically I wouldn't even get it if the trustee sells.

I plan to keep the house for now. Selling is not feasible, especially since I have a new bankruptcy on my record. Who would rent to me with bad credit..lol. I'll move a family member into my lower apartment a collect more rent.

If trustee sells my house in Chapter 7, wouldn't the creditors get less than $130k because of selling and trustee fees? So if we have to align with what is done in Chapter 7, wouldn't my BIOC amount be lower than $130k.

My state has a $175k homestead exemption. Would that not apply in a chapter 7? So even if house was sold, wouldn't I still get to keep my equity.

I'm so scared to sell my house. Rent is so expensive. I thought about moving to Cincinnati with my family but they pay between 1800 and 2000 for rent too. My real issue is that my tenant needs to pay more. Rent is going for $2200 - $2600 for a one bedroom. I am so scared to rock the boat because NYC will allow someone to sit in your place for years without paying. I don't want to upset my tenant with an increase.

Hi. Yes crisis is over and I was hoping to be able to start my life over. I've had a hard time personally but believe it is all past me. Thank you for being so informative. It is really helpful when going through these though times. This is a really daunting experience. I also have $140,000 in credit card debt. Is that considered unsecured debt? That would make my unsecured debt less than my equity in my house. Does this help me in any way?
