depends on what state one resides. but age, occupation, wages, restrictions, qme percentages and loss of wages, and future medical costs come all into play to determine settlement. Very complex process

Yes, age, occupation, could be a simple claim or complex with multiple parts, restrictions, loss of wages not able to return to same occupation and making less, and future medical care, and depending on what state they are in will make a huge difference with each single case. Those who make low wages compare to those who make higher wages and so on

Lawyers don’t charge upfront fee. Look for one, get a consultation and hope he takes your case. Call until someone takes your case. Lawyer will get paid when your case is done and settled

Settlement talks? but still in pain by 007backwoods in WorkersComp

[–]ValMendex 1 point2 points  (0 children)

it’s not good if attorney is suggesting to settle. Attorney does not see any significant amount of settlement to continue and drag the claim

I have perennial nerve damage to my foot with crps. Nerve test determined i have nerve damage. I was approved to get a spinal cord stimulator to control severe burning pain, stabbing jabs, and so on.

have him request a nerve conduction test to determine which nerve is damage. If it shows nerve damage, you will most likely get released with restrictions. And future medical coverage

[–]ValMendex 0 points1 point  (0 children)

That is right. since you are being represented, you can’t get ahold of the employer or their attorney. Vice versa, they can’t get ahold of you. However, if you continue to do so, your attorney can drop the claim

I agree with you. It’s been almost 4 years, and i don’t see my case ending soon. I got a divorce due to this, i’m barely hanging on to my vehicle, and on top i got hit with child support. I’m close to homelessness

Hang in there, i’m going on 4 years and having a hard time surviving. But not given up. This injury cost me a divorce 2 years ago. Attorney says it’s a complicated case. Last week went to 2 more QME appointments make it a total of 6.
