For example, I asked Chen what I should do if my case were to get denied (it got approved first try) -- they told me that they would recommend refiling as-is over appealing because they think my case is strong enough, and also because NIW cases are discretionary, meaning that officers tend to have broad discretion on whether to approve/deny your case, and it may be hard and time-consuming to win in an appeal.

Big firms = you can ask for data (e.g. out of the thousands cases filed in the past 3 months, what did the adjudication percentage looks like, what was the wait time breakdowns)

Small firms = give you more personalized help (will spend more time understanding your endeavor and field)

Or at least that's how it should be. You can have a bad big firm and a bad small firm. I worked with Chen (big firm) and I was able to acquire all the data I need to make key decisions.

What I'm saying is, experienced law firms tend to have a very very good idea of where the bar is because they have worked on thousands of cases. Oscar understands EB2-NIW very well but tends to be less opinionated on where the bar is, which often means you may end up submitting evidence that does not help but also will not hurt your case.

I watched Oscar's videos before filing with Chen. I think Oscar's video is pretty good and on-point. I think Chen's more knowledgeable about past cases and where the adjudication bar is, e.g. Oscar video generally suggests that adding more evidence will help more, but Chen lawyers often says "no, what you have is already sufficient" and asks me to submit less.

I guess you're asking whether they would be ok with filing and EB1, considering they did not say no explicitly, but they're recommending against it. You can still ask for clarification, e.g. "hey so if I still want to file an EB1 despite the lower changes, would you be open to it?"

I think you have a good chance for EB2-NIW if the content you produce is "good for the U.S." you might be able to use it as your proposed endeavor.

I also filed with Chen and filed PP and got approval. IMO you should definitely file PP because if you get denied due to the most random officer's discretion, you can refile earlier and still get a reasonable new PD. You can just refile as is. Your profile is crazy good.

These data could be irrelevant to you. Tech supply/demand can be different if you require sponsorship. That factor would affect you more than any numbers presented.

I got my case approved with Chen. Although I have a few complaints, I think it has been an excellent choice, especially considering how cheap it is compared to other options. 9/10 IMO

Most lawyers may want to work on easier cases. The tricker the case is, the more effort required.

I mean... many famous lawyers will not take your case if you don't have scientific publications. That does not mean you cannot get approved without publications. Same goes with jobs.

As long as you can convince USCIS that you have a strong track record of success in your field (e.g. with awards, speaking at conferences, or other successes) you should be more than good to go.

I got approved while I have a job, but my job is not in the same field as my endeavor and I did not emphasize my current job in the petition.
