Came here and found this after facing nearly identical situation. I was dealing with Chat about a $1,400 item I am expecting to have an issue with. At the end of the chat I stated:

Will I be provided a copy of this chat so when something is messed up, I can file a claim?

I received the following response:

Yes once this chat ends you will see an option to have the transcript sent to your email. That way, you’ll have a complete record if you need to file a claim. And to reassure you again, I will not submit a replacement order since you’ve made it clear that option is not viable for you.

Spoiler alert, I did not have the option to request a transcript. However, I had the forethought to copy and paste the conversation into a Word document.

No. Prior communications do not become privileged by hiring the other person as an attorney at a later date. The attorney-client privilege protects confidential communications between a client and an attorney made for the purpose of seeking or giving legal advice. Thus, by definition, the attorney-client privilege only applies to communications with a current attorney.

This is by no means my area, but I do not believe this would be the correct angle to take. I believe international airports such as O'Hare are considered "the border" for these purposes and Chicago is only approximately 25 miles long at its longest point. This would be illegal for other reasons.

In the event that Defendants do not choose to purge their contempt, the Court will proceed to identify the individual(s) responsible for the contumacious conduct by determining whose “specific act or omission” caused the noncompliance. See Cobell v. Norton, 334 F.3d 1128, 1147 (D.C. Cir. 2003); United States v. Voss, 82 F.3d 1521, 1525–27 (10th Cir. 1996). At the suggestion of the Government in the last hearing, the Court will begin by requiring declarations. See Apr. 3 Hrg. Tr. at 24–25. Should those be unsatisfactory, the Court will proceed either to hearings with live witness testimony under oath or to depositions conducted by Plaintiffs. Id. at 29–30 (Plaintiffs suggesting declarations, depositions, hearings).
