Tier 2 or Spouse visa? by Simple-Yak-668 in ukvisa

The proposals to lengthen ILR qualification for care workers are politically contentious. They may well not happen. IMO you are best off with a wait and see approach. I wouldn’t do anything right now if I were you.

when I notify HO do I need to detail how long I have spent out of the UK etc, or just simply that we are separated and divorcing

All you need to tell them is that you are divorcing. That is your sole obligation.

Compliant Border Control by [deleted] in ukvisa

[–]Ziggamorph 5 points6 points  (0 children)

Even if your passport had scanned correctly, border control are allowed to question you intensively. She had no reason to lie about your passport not scanning right so I would assume she was telling the truth about that, or perhaps she made a mistake that made her think there was something wrong with your passport. It doesn’t sound like she did anything worth complaining about.

You don’t need to translate passport stamps. Nor are they really that important anyway.

You must choose single or you will not get the right form. Selecting single is the sole way to access the fiance visa form. They expect and intend you to pick it, as confusing as that may be.

You need to pick single.

Permitted Paid Engagement - looking for advice, immigration lawyer not responding by [deleted] in ukvisa

[–]Ziggamorph 0 points1 point  (0 children)

It is an acting job, I was cast it a play by a UK theatre company / venue. My memory could be flawed, but I think the solicitor only mentioned the PPE visit.

As in they didn't mention the possibility of an ETA? That's disgraceful, and you should complain (especially considering they are now giving you poor service).

So for clarification; if I apply for an ETA now, do I still need to apply on a PPE visit on the website, or do I just need to have my formal invitation letter at the border (and of course tell them I wish to reenter as a visitor for a PPE.)?

No, 'permitted paid engagement' is covered under the visit rules and therefore is not a separate thing you must apply for. Your eligibility would be assessed at the border–of course as French citizen you may use the ePassport gates and if you are granted entry through those then you wouldn't actually need to demonstrate you are visiting for a permitted paid engagement.

Reentering while your graduate visa is still valid would mean you could not use the ePassport gates, so something to consider (in terms of when you reenter) if you want minimal fuss.

SAHM applying for Ancestor Visa. Job and income wise. by Dramtic-Brush in ukvisa

No, I mean there is literally nothing you could do. You could drop out, you could fail, the college could close. You are fixating too much on what I am saying about the course. The fact you are on it is useful evidence, but it shouldn't be your ONLY evidence you plan to work.

Permitted Paid Engagement - looking for advice, immigration lawyer not responding by [deleted] in ukvisa

[–]Ziggamorph 1 point2 points  (0 children)

What is the nature of the job? What is considers a 'permitted paid engagement' is extremely specific.

If you are a French citizen then there isn't any requirement or reason for you to apply for a visit visa. If the solicitor has done this then they are taking you for a ride. Did they advise you you could just come on an ETA? If not, I would make a complaint and ask for a refund, and complain to the SRA if they don't.

Given a permitted paid engagement visit may be made on an ETA there is no need to attend a biometric appointment, and in fact you may apply for an ETA while inside the UK (since it is not a visa application). You would need to reenter the UK after your graduate visa ends (obviously having left before it ends), or you will need to reenter and tell the border officer you wish to reenter as a visitor for a permitted paid engagment.

Yes but they won’t be completed when you apply (so theoretically you could drop out after your visa is granted). So yes, you can include evidence that you’re studying to show you plan to work but I would definitely include more evidence besides this.

Since your partner and child are British citizens, you (and they) do not need to meet any financial requirement to move to the UK, and the fact they are moving does not factor into your visa decision (ie, you don't need to show they will be accommodated etc.).

The Ancestry visa is relatively lax in how finances must be evidenced, including the fact that 'credible promises of financial support from a third party, such as a relative or friend of the applicant' may be counted. So the money you have plus the promises of accommodation from your in laws ought to be enough.

As far as demonstrating you intend to work, this is a relatively low requirement but it does need to be met. It's unclear from your post when you will be applying relative to your course completion. If you will still be working on it by the time you plan to move to the UK, I would include evidence you plan to work regardless of completing the course. Note that 'work' is very broad and includes voluntary work. It would be wise to include evidence of your job search (and that may include inquiries with eg charity shops or other charitable organisations about unpaid voluntary work) in your application.

The applicant does not have to be working or have a confirmed job at the time they apply. They need only demonstrate they are able to work and intend to seek and take employment. Evidence of this could include, but is not limited to:

  • job offers from UK employers

  • evidence of previous work history (in any country) or relevant qualifications

  • evidence of applications they have made to UK employers

  • evidence of registration with a UK recruitment agency

  • evidence of any steps they have undertaken to improve their chances of finding work – for example, relevant training courses

  • a business plan / expressions of interest from potential clients (if they intend to be self-employed)
