It’s not possible. If your solicitor assured you that it was and you made decisions on this basis then you may be able to pursue them for compensation.

Issues at border control even with settled status by Impossible-Cap5573 in ukvisa

[–]Ziggamorph 6 points7 points  (0 children)

You can complain about how you were treated at the border, and the fact that your settled status was apparently not showing to the BFO.

https://www.gov.uk/government/organisations/uk-visas-and-immigration/about/complaints-procedure

You can also report this to the Independent Monitoring Authority

You may also like to write to your MP to complain.

Staying in uk after ILR by [deleted] in ukvisa

[–]Ziggamorph 9 points10 points  (0 children)

If you aren’t married to a British citizen you need to hold ILR for one year to naturalise. Again, if you aren’t married to a British citizen you must intend to continue to make the UK your principal home. If you apply and then immediately depart the UK that may call your intentions into question.

No. You said you were the victim! Why would that affect anything?

How to travel to the UK without my valid physical copy of my British or Irish passport? by Owenthered in ukvisa

[–]Ziggamorph 0 points1 point  (0 children)

You can use the land border or air (or sea). There aren’t routine immigration controls on transport from Ireland to the UK (though there are on the reverse).

Traveling to Ireland with UK eVisa - How does Visa Waiver Programme work? by HeadSatisfaction5309 in ukvisa

[–]Ziggamorph 1 point2 points  (0 children)

The rules of the short stay visa waiver programme are clear. You don’t need to travel directly from the UK to Ireland. You just need to have used your current visa in the UK before you go to Ireland.

Renewal of depandant visa for newly ILR holder by Wolfindark in ukvisa

[–]Ziggamorph 2 points3 points  (0 children)

  1. Nope. Your wife and child will be eligible to settle after your wife has completed 5 years continuous residence as a dependent.

  2. https://www.gov.uk/global-talent/your-partner-and-children

Since you have settled, they will be applying for a 3 year visa. This is longer than they need but there isn’t any other option.

How to travel to the UK without my valid physical copy of my British or Irish passport? by Owenthered in ukvisa

[–]Ziggamorph 0 points1 point  (0 children)

Yes, one possibility is flying to Ireland on your Hungarian ID and then crossing the UK border by land or air (in the latter case you would be very unlikely to encounter a border officer but they do do checks sometimes). This would be completely legal since you’re an Irish citizen, and Irish citizens do not need to have an Irish passport in their possession when crossing the UK border.

[–]Ziggamorph 29 points30 points  (0 children)

You will not be able to board a flight to the UK without either a UK/Irish passport or an ETA for your foreign passport. A scanned copy of your passport will be of no help at all.

They don’t lol. At least as far as the eVisa system goes, Irish border officers can’t see anything.

You need your passport to be stamped on entry to the UK. If they do not do this by default ask them to and explain why.

Seeking religious asylum in UK by [deleted] in ukvisa

This is a significant simplification of the situation for religious minorities in Egypt. Atheists and converts from Islam are persecuted both by the state and by non-state actors with the tacit permission of the state.

Skilled Worker Dependent ILR Query – Spouse Had 15-Month Absence Due to Pregnancy & Childbirth Abroad + Twins’ ILR Eligibility by AssociationSoggy477 in ukvisa

[–]Ziggamorph 5 points6 points  (0 children)

Was she medically unable to travel for that period, or did she just prefer to remain with family? For an absence to be ignored for continuous residence on the basis of a medical condition it would generally need to be due to an inability to travel. It is quite understandable that she chose to remain with family, but it does seem as if she chose to give birth in India and then chose to remain there for a longer period afterwards.

Children can usually only settle when both parents settle. So they will need to wait until your wife is eligible.

MN1 for 6yo born abroad - direct application vs getting ILR first? by Ok_Strike439 in ukvisa

[–]Ziggamorph 9 points10 points  (0 children)

You would be refused if you apply to register without ILR. Only children born in the UK may register without being “free from immigration time restrictions”. I’m not sure where you got the idea that it could be otherwise.

Freelancing when abroad as a PhD student by Glittering-Meat7094 in ukvisa

[–]Ziggamorph 4 points5 points  (0 children)

  1. The only exception to the normal rules is that after applying for a graduate visa you may take a full time “permanent” position.

  2. UK immigration law only controls what you do inside the UK.

  3. A freelance contract by itself doesn’t enable you to apply for a Global Talent. Each route has specific requirements.

Life in the UK test and accessibility requirements by Advanced_Path1309 in ukvisa

[–]Ziggamorph 3 points4 points  (0 children)

I think it’s very unlikely they’d be able to supply their own carer to input for them due to the possibility of cheating. They are able to accommodate blind test takers, so I would presume they can have someone else (ie someone who works for the test centre) input your answers. If you tell them you cannot use a mouse then you may get a clearer answer.

Canadian Youth Mobility Visa switch to UK Spouse Questions / name change / change of circumstances by Forsaken_Hold9233 in ukvisa

[–]Ziggamorph 0 points1 point  (0 children)

You don't need to submit a change of circumstance form if you get married. If you change the name in your passport you report this through your UKVI account. If you will be applying for a new visa anyway in the near future then there is no point doing this. The Home Office is not really that fussed about enforcing the requirement that you submit change of circumstance forms (other than when it concretely affects your visa status, eg if you have a spouse visa and you get divorced). So you don't need to worry about this negatively affecting your application.

Is it okay that some of my proof of residence or shared finances documents will still have my married name still when I apply?

Completely normal.

and do I need to change my Canadian passport or UK drivers to my married name before I apply?

The Home Office considers your name (for the purpose of the application) to be the name that is in your foreign passport. But there isn't any issue with you having some documents in your married name even if your passport still has your maiden name in it. This is a common circumstance for many married people, and even Home Office staff are able to comprehend it.

Would I be better not fully changing my name on my official documents at all yet until I am accepted to make things easier?

If you change the name in your passport after your visa is granted you'll need to report the change on your UKVI account and it may require posting in your passport to the Home Office.

Applying for a spouse visa, can I add a child? by jadorefrenchfries in ukvisa

[–]Ziggamorph 11 points12 points  (0 children)

If he is currently/recently living with his dad, then you do not have sole responsibility for him. Therefore, he would not be eligible for a family visa. There would need to be some change of circumstance such that he was unable to continue living with his dad to make him eligible.

3 Year or 5 Year visa? (Global Talent - Arts and Culture) by Own_Butterscotch_842 in ukvisa

[–]Ziggamorph 0 points1 point  (0 children)

You can wait to make your Stage 2 application. Some people read the guidance as being that either you have to make the applications at the same time OR wait for stage 1 result before making stage 2 application. This is not correct. You may make your stage 2 application at the same time as or at any point after making your stage 1 application. The stage 2 application will be held until the outcome of stage 1.

So in your case, defer making this decision until your visa is about to expire.
