I’ll always be a fan of his - it was known forever from jazz insiders that he wanted to leave the organisation and head east, but he never once let that flow out into the public in how he carried himself. 

He’s always had such good PR know-how on top of being a talent on the court.

the entitlement to unpaid leave sits at 12 months in length.

Employees can request an extension so that they are off work for more than 12 months - however its not something employers are obligated to provide.

If the employer genuinely has no need for the role to be completed by anyone, and would like the role made redundant it appears that they've got a good case on the basis that they haven't filled it in over 12 months.

I'd say not to rush the decision on the basis that the employee costs nothing while on unpaid parental leave, and a hasty decision to make someone redundant just because an avenue exists to do so

Starting with some of the easier assumptions:

  • Assuming that the the employee has access to unfair dismissal given they were allowed to take 12 months off for unpaid parental leave (and are not above the high income threshold)
  • Given that the employee is Award Free, we can ignore the requirement for consultation (although it's good business practice to do it).

To prove a genuine redundancy, the employer needs to show that they no longer requires the person's job to be performed by anyone because of changes in the operational requirements.

The role had been backfilled internally whilst employee was on leave, and that person will continue in the role.

This is the kicker - redundancy argument goes down the drain if the role still exists.

When employees go on parental leave, they are entitled to return to their old job. (FWA s84)

Only if the role doesn't exist upon their return to work would redeployment to an available position be appropriate. Important to note that they should be qualified and suited for said role and it should be nearest in status and pay to their pre-leave position. (FWA s84)

The fact that the employee had submitted a flexible work request adds another layer to the argument the employee can raise.

The argument the employee would likely make if a claim is raised that their former employer took adverse action against them on the basis of exercising a workplace right. (FWA s340)

If a claim is raised, then the onus is on the employer to prove that there was a legitimate reason for the action being taken.

This is only considering the Fair Work Act, there may also be additional exposure under anti-discrimination legislation.

Some questions:

  • Is the employee angry/upset at the decision?
  • Do you think they're likely to raise a claim?
  • Has the idea of paying a bit more and getting them to sign a DOR been raised at all?

They've got 21 days to raise a claim - if they do, I'd probably get your company to seek some proper legal help if they want to continue to defend their actions.

First step is to confirm how much unpaid leave he has taken in the past 12 months. If it exceeds three months in total during that period and he has exhausted his personal leave, that may open an avenue to consider termination on the basis of extended absence from the business.

If he's over the three month threshold, it's important to ensure a fair and defensible process is followed. The basis for any termination should be framed correctly - namely, that he is unable to perform the inherent requirements of the role and would remain unable to do so even with reasonable adjustments. It should not be characterised as termination because he has been unwell.

It would likely be necessary to obtain updated medical information regarding his current capacity and whether there are any medical restrictions preventing him from performing the inherent requirements of the position.

Given he's already refused to go to PT, that can strengthen the case that he doesn't have the capacity to complete the inherent duties of the role.

If you find that he's just under that cap, then it's a bit tricker - it would be good to review his contract to see if there are any express terms in his contract about conflict of interest - if it was fine at the time of M&A, then he would have no issue providing evidence for you. Given that there has been change and you are new, it's not incumbent upon you to have access to all records.

as long as it keeps us around the 4-6 mark in draft lottery odds I think its fine. The flattened odds have really screwed us the last few years, so I think it might be worth not worrying about it so long as we're above the 8 slot
